I got an interesting certified letter from my County sheriff yesterday. It seems under Ohio's new AWA act I am tardy with my new registration requirments and if I do not get to the sheriff's office by Thursday I will be charged with a felony.

HHHHmmmm this doesnt sound like a civil action to me it sounds downright criminal. Also the letter reads that I have been convicted and classified as a tier 2 sex offender.

Now I remember my conviction 8 years ago where I signed a paper stating that I had to register as a sexually Oriented offender for 10 years.I even remember filing my challenge to re classificagtion under the AWA act last December but I must have blocked out all of this other due process this letter implies I have had.

My crime has also changed from attempted corruption of a minor to unlawful sexual conduct with a Minor withjout any explanation or notification. I am honestly perplexed as to what criteria they used to give me such a bump in rank as I look at others on my county list that have the same crime listed next the their names they are still classisified as tier 1.

In any case I guess I had better go see my local donut chomper so that this civil case does not end in a felony conviction. What a country

Hello Mr Dann: I am one of the RSO'S that you were trying to further punish with your premature politically motivated passage of the AWA act.

You will have to excuse my choice of words but I can only tell you that I sit here in "orgasmic Joy" as I watch YOUR PUBLIC HUMILATION being forced to admit that you had at least one sexual affair outside of your marriage.

Also your claim that you will not resign warms my heart because it means days or even weeks of watching you squirm under the pressure.

There are claims that your office was more a frat house rather than the top law enforcement office of the state. Your career is OVER MR DANN and this will haunt you for the rest of your life.

I am a zealous advocate for former offender rights and my name and address has appeared in the local newspapers a few times as a result of that.

Mr Dann? You are the talk of the state in local pubs as well as all legal circles churches and everywhere else in the state of Ohio. You will ALWAYS be known as the PERVERT Attorney General.

How does it make you feel now that everyone knows about your personal failures as a man? You will not have to go down and register anywhere Mr. Dann but it warms my heart to know that you will never get past this scandal as long as you live. You have no idea the pain and shame that are in store for you , but I do.

Abandon all hope you are a disgrace to the Office and you know it. You will eventually resign in humiliation and you know it. You will FOREVER be remembered for this event and it brings cheer to my heart.

State-funded therapy for sex offenders halted

Psychologist, sheriff call cuts dangerous By Carl Chancellor Beacon Journal staff writerPublished on Sunday, Mar 23, 2008 Recent cuts to Ohio's prison budget means the state has stopped paying for counseling services for paroled sex offenders across the state, including the more than 800 supervised sex offenders living in Akron. Those cuts are a great concern to Dr. James A. Orlando of Summit Psychological Associates, which at any given time treats between 125 and 200 sex offenders in Summit, Stark, Portage, Tuscarawas and Mahoning counties. ''This is a dangerous situation . . . It's a serious public safety issue,'' said Orlando, a trained clinical psychologist. Orlando said the decision by the Ohio Department of Rehabilitation and Correction to no longer pay for the treatment of paroled sex offenders beginning in March,means that there are high-risk sex offenders, who represent a very real danger to children and adults, walking the streets of Akron unchecked. ''They are being left to their own devices not to re-offend. If we don't find a way to manage them in the community, there are going to be more sex offenses and more people are going to be victimized,'' Orlando said. As part of trimming the department's $1.7 billion-plus budget for 2008 by $71 million, it was decided to no longer pay for the counseling and treatment of paroled sex offenders. ''The cuts came without any warning. We got a letter on Feb. 28 that said on March 3, the program would be cut,'' Orlando said. As a consequence, his and other counseling agencies across the state are scrambling to provide crucial treatment services to paroled sex offenders. ''We've set up a sliding scale and are offering minimal co-pay (options),'' Orlando said. The hope is if the treatment programs are as affordable as possible, sex offenders will voluntarily seek treatment for their conditions. However, Orlando is dubious. He said many paroled sex offenders are unemployed and find it difficult to find jobs because of their felony records. ''They just can't pay for treatment,'' Orlando said. He said the state payment of about $35 per client for a group counseling session made it possible for sex offenders to go into treatment. Orlando said he plans to approach county mental health boards for possible funding. Summit County Sheriff Drew Alexander shares Orlando's concerns. ''Without treatment, the odds go up that they are going to re-offend,'' Alexander said. He called the situation a real ''Catch 22.'' ''They are told that as a condition of parole they have to seek treatment, but the state is no longer going to pay for it . . . I'm just dumbfounded. I don't understand it,'' Alexander said. Budget cuts Linda Janes, the ODRC's deputy director of the division of parole and community services, said the cuts were an unavoidable consequence of budget constraints. ''As part of our cost-savings effort we've cut all external treatment contracts statewide,'' Janes said. She said the department previously spent roughly $1.3 million a year funding external treatment programs for sex offenders. ''We feel absolutely awful about the cuts but it's a consequence of the budget crisis,'' Janes said. She said the ODRC has taken a ''multifaceted'' approach to cost-cutting, which in addition to eliminating external contracts, includes making staff cuts and other cost-savings initiatives. One of those initiatives, Janes said, has been to shift the task of counseling paroled sex offenders to the department's Adult Parole Authority. ''We are in the process of training in-house staff now to provide that treatment. Hopefully, that will begin in May,'' Janes said. She said sex offenders on parole will be able to go to adult parole offices, which are located in every county, for treatment and counseling. Coping strategies Summit Psychological Associates and Orlando have for more than 20 years been providing sex offender treatment, which is modeled on the Alcoholic Anonymous approach. ''Since 1984, we've been teaching sex offenders to recognize high-risk factors and we help them develop strategies and behavioral controls to allow them to live out the rest of their lives without re-offending,'' Orlando said. Still, Orlando admits that there is no way to cure a sex offender. He said the group therapy sessions provided by his agency, which initially are offered weekly and then on a monthly basis, teach offenders behavioral controls that make it much less likely they will re-offend. Orlando said the ''heart of sex-offender treatment'' is to give offenders the tools to control their urges. ''Even though you (an offender) will still have deviant desires, you won't act on it,'' Orlando said. ''But right now we have a situation where these guys are getting out of prison with no training and without the tools to know how to cope with their urges . . . ABC'S 20/20 HITS HOME RUN WITH RSO SEGMENT

I had to watch it twice. I am still reeling in disbelief at the fact that a national news program has finally taken on this issue backed up by something close to the real statistics along with balanced journalism.

This is the first real departure from the norm. This is the first time that I know of where something close to the “other side” of the story has been presented and aired instead of the usual “hatchet job” that we have become so used to.

They held Petra Looney’s feet to the fire and simply made a rational comparison between her site and Jan Kruska’s site Operation Awareness and the insanity hate and venom “CLEARLY” showed thru.

The segment also showed another vigilante who picks and chooses who she decides to print flyers about then she takes it upon herself to pass them out. John Walsh, Marc Klass, Mark Lunsford, and so many others have taken out their hate and bloodlust upon the RSO community becoming the very monsters they say they are crusading against and it is FINALLY EXPOSED.

I think Jan stand’s a very good chance of winning her lawsuit because she has the documented facts on her side. I will go as far as saying that I feel the tide is starting to slow as the sex offender Goldmine starts to tap out.

Mark Foley co sponsored the AWA act that is slated to become law in all 50 states. Then gets busted sending sexual solicitations to teenaged boys online? New York’s governor who was so tuff on prostitution is now fully exposed and busted committing the same crimes he has rallied against?

Thousands of Teenagers across America are now on the RSO list their young lives forever altered because someone was 2 weeks below the legal limit?

I loved the interview with the father that regretted beating up a teenaged boy stating that if he had it to do over he would tie a rope around his neck and drag him down every highway.

The hate and venom along with the political gold that these cases bring was “FINALLY” exposed as the Arizona lawmaker was interviewed. He was clearly unconcerned about the collateral damage that these laws create but seemed a little stunned about actually getting called on it.

It was a true victory to watch the facts finally discussed and to watch a national news magazine finally question what has been sold as facts by the likes of Mark Foley and others was truly refreshing.

Ex-Reserve Deputy Charged With Child Seduction

Police: Man Admitted Inappropriate Contact With Boy

LEBANON, Ind. -- A former Boone County reserve deputy is accused of seducing a child in an incident at his home last week.

Randy Wise (pictured), 31, faces one count of child seduction. Authorities said he admitted performing a sex act on a 16-year-old boy, 6News' Renee Jameson reported.
The teen told investigators that he met Wise at a church and spent the night at his rural Lebanon house last Friday after working with him at a school concert.

"The boy is telling us that Mr. Wise, while the boy was sleeping on the couch, started to fondle him … and had him touch him in inappropriate places," said Boone County sheriff's Maj. Mike Nielsen.

Wise resigned as a reserve deputy at the Boone County Sheriff's Department last May. He also once worked at Witham Hospital in Lebanon.

"That is one of the most disturbing things about this case -- that it was against a child and it was somebody that the public has entrusted, used to entrust, to be a police officer in Boone County, to be an EMT, to be a paramedic," Nielsen said. "There's basically no trust there anymore."
Before he bonded out of jail on Monday, Wise told police that the victim had told the truth, that he was sorry and that there are no other victims.

"I can tell you that if we continue this investigation and we find more allegations that have taken place, we will present those to the prosecutor's office," Nielsen said.
Police said they have no indication that additional crimes took place, but they are continuing to investigate.

If Wise is convicted, he could face up to three years in prison.

James Barbour Pleads Guilty to Endangering Welfare of a Minor

James BarbourActor James Barbour has pleaded guilty to two misdemeanor counts of "endangering the welfare of a minor," in relation to an incident that happened with a 15-year-old female fan during the run of the 2001 Broadway musical Jane Eyre, according to the Associated Press. He is expected to receive a 60-day jail sentence and three years of probation on February 29.

Barbour originally pleaded not guilty to nine counts of engaging in criminal sexual abuse, sexual abuse, and endangering the welfare of a child. According to AP, Barbour has now admitted he sexually touched the girl when she visited him backstage and when she visited his apartment at a later date. He will not have to register as a sex offender, since the new charges are misdemeanors.

Barbour most recently appeared on stage in Florida in the world premiere of A Tale of Two Cities. His other Broadway credits include Assassins, Carousel, and Beauty and the Beast.

{As some of you know I have been taking a few days off after the death of my father. I had actually shed tears of shame today because I know that it is now impossible to live in a world where my name has been cleared"so to speak" in the eyes of my father.

My father was the ONLY one that was in my corner, due or die, thru my conviction and all the witch hunts that followed. It is true that he may have underestimated what I had done being naturally biased but that shrinks and pales in comparison to what Is now passing as justice in our country.

This man committed a very similar crime but because he had connections and a good Attorney he got a pass. This is not a letter to bitch and whine about his good luck this is an open letter for the doubters and haters to TAKE A LOOK at the DOUBLE STANDARD slapping you in the face.

If you cheer my pain I say "drink your fill" on my pain and despair and eat your pound of flesh.

Spreading "1 in 5" Number Does More Harm Than Good

Regular Slashdot contributor Bennett Haselton has some opinions on child safety online and the use of fear mongering. Here are his thoughts. "The National Center for Missing and Exploited Children has been running online ads for several years saying that "Each year 1 in 5 children is sexually solicited online", a statistic that has been endlessly repeated, including by vendors of blocking software and by politicians who often paraphrase it to say that 1 in 5 children "are approached by online predators".

While others have quietly documented the problems with this statistic, lawmakers still bring it out every year in a push for more online regulation (pre-emptied this year only by the topic du jour of cyberbullying), so it's time for anti-censorship organizations to start campaigning more aggressively against the misleading "1 in 5" number. That means two things: framing the debate with more accurate numbers, and holding the parties accountable for disseminating the wrong ones -- and that means naming names, including those of organizations like the NCMEC that are normally beyond reproach." I have no doubt that on balance, the world is a better place because of the NCMEC and what they've done, and God knows how I'd feel about them if they'd helped me find a lost child. But the good things they've done shouldn't be viewed as political capital that they can withdraw against in order to be above criticism for spreading the "1 in 5" meme. The longer they go on implying to parents that there is a 1-in-5 chance their kid will be asked by an adult to meet in person for sex, the more I think it tarnishes their whole legacy. (The NCMEC did not respond to contact requests for this article.) First, what the 1-in-5 number actually means.

It originated with a study done in 2000 by the Crimes Against Children Research Center at the University of New Hampshire, which surveyed 1,501 Internet-using youth age 10 through 17.
The actual relevant findings of the study were as follows:
The 1 in 5 figure was the number that had received at least one instance of unwanted sex talk (including from other teenagers), or sex talk from an adult (whether wanted or not), in the past year.
The proportion of respondents who received a sexual flirtation from an adult, followed by a request to talk on the phone or meet in person, was about 1%.

The number of survey respondents who actually befriended an adult online and then met the adult in person for sexual purposes, was zero.

Specifically: About 19% of respondents said had received a "sexual solicitation or approach" (my emphasis), and "sexual solicitations and approaches" were defined as: "requests to engage in sexual activities or sexual talk or give personal sexual information that were unwanted or, whether wanted or not, made by an adult".

That means any unwanted sex talk, including from other teens, even if limited to one occurrence in the entire previous year, would cause a respondent to be included in the 19% figure (which, when you define it that broadly, actually sounds pretty low). To say that those 1 in 5 minors were "sexually solicited" -- literally, asked for sex -- is simply false.

The actual proportion of respondents who reported that someone made sexual overtures and asked to talk on the phone or meet in person -- what the study called an "aggressive sexual solicitation" -- was 3%, and 34% of those requests were known to have been made by adults. And even this overestimates the proportion of minors who were truly "sexually solicited", because all it means is that an adult started out by talking to them sexually, and then made some request for offline contact, which could have merely been asking for a phone number. So the scenario that comes to mind when hearing that "1 in 5 children is sexually solicited online" -- of being approached sexually by an adult and asked for an in-person meeting -- had actually happened to no more than 1% of respondents, and probably much fewer than that.

And this is just considering the percentage of youth who received solicitations, not taking into account how they responded. Out of 1,501 youth surveyed, none of them reported actually meeting an adult in person for anything that they described as sexual contact. Two teens in the study had "close friendships" with adults that the authors wrote "may have had sexual aspects". One 17-year-old boy had a relationship with a woman in her late twenties that he described as "romantic" but not sexual, and they never met in person.

Another 16-year-old girl became close to a man in his thirties, and they met in a public place, but she described the relationship as non-sexual, and she declined to spend the night with him. (While these could still be considered "close calls", it's worth noting that even if the 16- and 17-year-olds had actually had a sexual relationship with their adult friends, that would have in fact been legal in many U.S. states, and in any case it's not what most people think of when they hear about "children" being "sexually solicited online".)

Of course all of this depends on the accuracy of the answers that the youth gave to the surveyors. But the "1 in 5" figure was based on the youths' stated responses as well. People who cite the study can't have their cake and eat it too, taking the "1 in 5" number as accurate but discounting the fact that none of the teens surveyed reported a sexual relationship with an adult they met online. These were the data that were available in 2000, when the "1 in 5" number started being spread. The authors of the original study followed up with a 2005 report, "Online Victimization of Youth: Five Years Later", in which the corresponding statistics were:
1 in 7 respondents received unwanted sex talk or sex talk from an adult, at some point in the past year.

The proportion of respondents who received a sexual flirtation from an adult, followed by a request to communicate offline, was again about 1-2%. (4% of respondents reported a sexual flirtation plus a request to correspond offline. The new study reported that 39% of all sexual solicitations were made by adults, but did not say what proportion of "aggressive sexual solicitations" -- which included requests for offline contact -- were made by adults.)

Out of 1,501 respondents surveyed in 2005, two did report an in-person meeting that led to a sexual crime -- one was a 15-year-old girl who met a 30-year-old man in person and had consensual sex with him, and another was a 16-year-old girl who went to a party with an older male she met online who later tried to rape her. But even these incidents (which were both reported to law enforcement) do not mean that the Internet is a more dangerous environment for youth with regard to interaction with adults. The National Center for Missing and Exploited Children's own Web site links to a study -- also by one of the authors of the "Online Victimization" report -- which found that when all types of abuse are counted, 20% of females experience some type of sexual victimization before adulthood, compared to 2 out of 750 female survey respondents in the "Online Victimization" study who reported sexual abuse by someone they met online.

The NCMEC has updated their Web site to say that "one in seven youths (10 to 17 years) experience a sexual solicitation or approach while online", although the banner ads still say 1 in 5. But I think the 1-in-7 versus 1-in-5 is hardly worth nit-picking, when the real problem is that the statement "1 in 5 children is sexually solicited online" is written in a way that virtually guarantees it will be mis-heard and passed along as a statement involving "online predators" or "pedophiles".

"Authorities Say 1 in 5 Children Has Been Approached By Online Predators" reads the sub-heading of a story on ABC news. "20% of children who use computer chat rooms have been approached over the Internet by a pedophile" says an online safety site sponsored by the Albemarle County government in Virginia. "One in five kids in America are approached by online predators" says a Congressman's press release.

The NCMEC itself never says that 1 in 5 or 1 in 7 children is "approached by a pedophile", merely that they are "sexually solicited online". I still think this is false because that is not the proportion of minors who are literally solicited for sex, but suppose that you expanded "sexual solicitation" to include all sex talk, so that the statement was "technically true".

That still misses the point, because the issue shouldn't be seen as a game where sides try to make their statements as alarmist as possible while still being "technically true", like the kid with his petition to ban "dihydrogen monoxide".

If you say something that is virtually guaranteed to get passed along as a wrong and alarmist statement about "pedophiles", aren't you at least partly responsible? Why, then, does the NCMEC do it? Their site does have a "Donate" link, but it's very low-key, and the site generally seems to steer first-time visitors towards actions that they can take with regard to their own children. So I'm not cynical enough to think the "1 in 5" statistic is a campaign to scare up donations; I think they really do believe they are doing good by getting people to believe that number and to take action based on it.

The problem is that there is such a thing as too much worrying and too much overprotection. Sites like Facebook are often used to organize parties and events and send out venue changes, just because that's the most efficient way to do it, and if your parents ban you from getting on Facebook, you'll miss out on simple things like that. What good does that do for anybody? Critics of overprotection often say that overly sheltered kids may rebel later on and get themselves in worse trouble, and that's often true, but so what even if they don't?

Your quality of life is still worse off if you're the only one in your peer group who can't get updates about your friends' parties. And your parents' quality of life will be worse if they're constantly wringing their hands thinking that there is a 1 in 5 chance their kid will be propositioned online by a pedophile.

So I would urge the NCMEC to reconsider what they're telling people. Regarding the "1 in 5" meme that's already out there, it's spread so far that it's probably too late for the NCMEC to put the genie back into the bottle. But any anti-censorship group participating in a debate about online safety should put the real statistics forward, and since many in the audience will have heard the "1 in 5" figure somewhere, take a minute to knock it down as well. You don't have to commit political suicide by calling out the NCMEC specifically for spreading the "1 in 5" number, but put the right numbers out there. Unfortunately the subject of child safety is such that wrong information, from any source, is unlikely to be criticized if it's erring on the side of caution, but some memes die faster than others.

Microsoft's resource page about "online predators" says that "if you find pornography on the family computer" -- not child porn, but regular pornography -- that could be a warning sign that "your child is the target of an online predator".

I think that's a wildly irresponsible thing to be telling parents, but fortunately the meme does not seem to have spread beyond that one page, which probably not one parent in a thousand will ever actually read.

(WPRI) -- A sexual predator is just days from getting out of prison and he'll never have to register as a sex offender.
He falls into the crack of a legal loophole. Because of the way the law is written in Rhode Island, certain sex criminals will never have to register with police when they're released from the Adult Correctional Institution.

Target 12 Investigator Tim White has been tracking these sex offenders for more than a year. He has the details on this latest release.
In just 5 days (March 1, 2008), a man who sexually assaulted three young girls, will walk away from the ACI a free man.

Wherever he ends up calling home the police won't be able to tell you anything about this sex offender. So we will.
His name is Dino Dalessio. Convicted on multiple counts of sexual assault and child molestation you would think when he gets out of prison this weekend, he'll have to register as a sex offender. Think again.

Alan Goulart, Chief of the Rhode Island Attorney General's Office Criminal Division says, "it is troubling, what's troubling is law enforcement doesn't have a tool that will allow them to know where a sex offender is."

His crimes are disturbing. Dalessio was sentenced for 5 counts of sexual assault and 2 counts child molestation. Prosecutors say he raped three girls known to him, several times from 1984 to 1989. The youngest victim was only 10 years old when Dalessio was finally arrested by the Providence police.

But despite this record, wherever he goes, he won't even have to register with that town's police department.

Goulart says, "They need to be better managed right now."
Alan Goulart with the Attorney General's Office sits on a legislative commission designed to fix this problem.

Under state law anyone who was convicted of a sex crime before 1992, does not have to register as a sex offender. The courts ruled the law is not retroactive.
Goulart says, "There will be some legislation that will be enacted which will look at all those problems including the retroactive application of the statute."

The question now is, where will Dalessio live when he gets out? That is unclear. But Target 12 Child Watch combed through public records and we can tell you where he's called home in the past. He's lived in Johnston near the Providence line, and most recently in Warwick, not far from the airport.

In an ironic twist Dalessio was convicted of his sex crimes in June of 1991. Had the trial wrapped up just six months later, when the sex offender registry went on the books, it would have been a different story.

This is not the first sexual predator we've told you about who falls into this legal loophole, and it won't be the last.

Cop accepts guilty plea

A Cincinnati police officer accused of raping a woman who had summoned help pleaded guilty today to two charges of sexually battery, ending his trial after nearly two weeks.
Sgt. William Simpson, 47, was accused of raping the woman after he was sent to her home after her boyfriend beat her.

Under the terms of the deal, Simpson will serve six months in jail, spend five years on community supervision and get treatment as a sex offender. In addition, he resigned from the department this morning and agreed not to seek reinstatement.

Prosecutors originally charged Simpson with three counts of rape and three of sexual battery.They said today they agreed to the deal to spare the victim for having to testify again.Simpson’s lawyer, Merlyn Shiverdecker, kept the woman on the stand for three days last week and asked her repeatedly about the incident and sexual positions.The woman agreed with the plea deal.

Did Pedophilia Hysteria Cause Child's Death?

On Nov. 28, 2002, 2-year-old Abigail Rae died by drowning in a village pond in England. Her death is currently stirring debate because the ongoing inquest revealed an explosive fact. A man passing by was afraid to guide the lost child to safety because he feared being labeled "a pervert."

In the article "Day of the dad: paedophilia hysteria leaves men afraid to help," The Telegraph raises a question that applies equally to North America. Have high profile cases of pedophilia created such public hysteria that the average decent human being, especially a man, is now reluctant to approach a child in need?

Consider what happened to Abby. The toddler wandered from her nursery school, Ready Teddy Go, through a door left open. A bricklayer named Clive Peachey drove past her in his truck. At the inquest, he stated, "I kept thinking I should go back. The reason I didn't was because I thought people might think I was trying to abduct her."

Instead, he assured himself that the parents must be "driving around" and would find her.
A few minutes thereafter, Abby fatally fell into an algae-covered pond. Meanwhile, the nursery staff searched. When the mother noticed the staff near her home, she was told they were looking for a "lost dog" but the truth soon emerged. The frantic mother's search ended when she leaped into the pond to fish out what she thought was Abby's shoe.

She stated, "As I grabbed for the shoe, I missed and was shocked to touch what felt like a leg. I pulled the leg upwards." The dead child emerged.
Abby's case may be extreme but it hinges on a question that commonly confronts everyone who interacts with other people's children. Is it possible to touch a child in a non-abusive manner without risking terrible repercussions?

Before moving to this question, however, it is necessary to consider a related issue that arises in almost every discussions of Abby. Is Clive Peachey legally or morally responsible for her death?
For several reasons, I argue that he is not. First and foremost, the responsibility lies with the nursery staff who became her guardians. Abby was in no immediate danger when Peachey saw her and he contacted the police upon later hearing a 'missing child' report.

Arguably, if he had phoned the police immediately, Abby would have been dead long before they arrived. Moreover, by coming forth, Peachey has accepted the damage to his life that comes with the public disgrace of saying "I drove past her."

Important information in judging Peachey is missing. For example, if Peachey has a family, he may have been reluctant to place his reputation or livelihood at risk. He may have balanced possible harm to his own children against helping a stranger's child.

Peachey's fears have precedence on this side of the Atlantic.
Last summer, an Illinois man lost an appeal on his conviction as a sex offender for grabbing the arm of a 14-year-old girl. She had stepped directly in front of his car, causing him to swerve in order to avoid hitting her.

The 28-year-old Fitzroy Barnaby jumped out his car, grabbed her arm and lectured her on how not to get killed. Nothing more occurred. Nevertheless, that one action made him guilty of "the unlawful restraint of a minor," which is a sexual offense in Illinois. Both the jury and judge believed him. Nevertheless, Barnaby went through years of legal proceedings that ended with his name on a sex offender registry, where his photograph and address are publicly available. He must report to authorities. His employment options are severely limited; he cannot live near schools or parks.

Arguably, the law would have punished Barnaby less had he hit the girl or not cared enough to lecture her. Perhaps that's the equation that ran through Peachey's mind.
Again, Barnaby is an extreme case. But ordinary people make decisions on how to interact with children based on such high profile stories.

The effect on average people in non-extreme situations can be partially gauged through a study conducted by Dr. Heather Piper at Manchester Metropolitan University: "The Problematics of 'Touching' Between Children and Professionals." Piper examined six case-study schools through interviews with teachers, parents and children regarding the propriety of touch.
Commentator Josie Appleton reviewed the study, "Reported cases include the teacher who avoided putting a plaster [bandaid] on a child's scraped leg; nursery staff calling a child's mother every time he needed to go to the toilet; a male gym teacher leaving a girl injured in the hall while he waited for a female colleague."

One school reportedly kept an account of every 'touching incident.' They stated, "We write down a short account and date it and put which staff were present and at what time, we then explain it to the parent and ask them to read and sign it."
Appleton observed that this is more in keeping with "police logs than teaching children."
The last words encapsulate the problem.

Touching a child, even to render medical assistance, has become a potential police matter.
Child abuse must be addressed but it is worse than folly to punish those who help children. Our society is creating Clive Peachey -- decent men who will walk away from a child in need.
Abby Rae died not only from drowning but also from bad politics.

I had to track down the actual court documents in this case because I just could not believe this was true. A 13 year old girl gets pregnant from her 12 year old boyfriend. She gets charged with a sex crime??? On appeal SHE LOST the case??

The Judge said he was sympathetic to her situation but and this is a quote "the law is there not only to protect children from adults but to protect them from eachother" I could not make this case look any more ridiculous if I tried.

State officials say danger of sex offenders may rise as legal provisions lead to more homelessness.

SACRAMENTO -- -- The law voters passed to crack down on sex offenders could actually be increasing the danger such offenders pose by driving them into homelessness at a significant rate, members of a state board said Thursday.In the 15 months since voters approved Jessica's Law, which restricts where paroled offenders may live and requires electronic monitoring of their whereabouts, the state has recorded a 44% increase in those registered as transients, according to a report released by California's Sex Offender Management Board.

The law prohibits ex-offenders from living within 2,000 feet of places where children gather, but it lacks adequate definitions of such places, the report says. And in some counties and cities, the law's residency restrictions make large swaths of housing off-limits.Unresolved questions about major parts of the law make it impossible to determine whether the state is safer now from sex offenders, panel member said. Some said the law could be making things worse.

Tom Tobin, the board's vice-chairman and a psychologist, said that homelessness removes offenders from their support systems, such as family members, which increases the chances they will commit new crimes."I see homelessness as increasing overall risk to public safety, and as a very, very undesirable consequence of probably a well-intended law," he said.Officials on the panel said in interviews that many parts of the law, which involves harsher sentencing for sex offenders, were not complicated.

But many California locales are not fully enforcing it because of confusion about who is covered by it and how it should be applied, according to the report, which is the first formal look at the workings of the controversial measure, approved as Proposition 83 in November 2006. The 15-member board was created by lawmakers and the governor to examine how the state handles sex offenders.

There are 67,710 registered sex offenders in California communities, the report says. The state Department of Corrections and Rehabilitation has identified 4,345 offenders on parole that it says are subject to the law, but members of the state panel said it is unclear who else may be because the law is vague. The number of transient sex offenders who could be homeless or moving from house to house increased from 2,000 more than a year ago to 2,879 today. "If they're transient or if they're homeless, that might actually bring their risk [of re-offending] up quite a bit," said Suzanne Brown-McBride, the board's chairwoman and the director of a victim-assistance group in Sacramento.

The report pointed out that what enforcement there is generates millions of dollars in costs to the cash-strapped state.California's corrections agency is spending an estimated $20 million a year to monitor more than 3,000 paroled sex offenders by global positioning system satellite technology. That is a fraction of those who would eventually have to be watched. The law also reduced from two to one the number of past sex crimes that requires an offender who leaves prison to be evaluated by a mental health expert.

The purpose is to determine whether he or she is a "sexually violent predator" and eligible for commitment to a mental hospital. The new evaluations increased costs to the state from $3 million to $27 million, the report said. But confinements did not markedly increase, Brown-McBride said.The report suggests that the public misunderstands the best way to protect against sex offenders.

It cited studies showing that residency restrictions in other states did not reduce the number of new crimes committed by sex offenders.And it cited a national survey that found nine out of 10 sex crimes are committed by acquaintances or relatives of victims, undercutting the notion that keeping them away from schools and parks makes a difference.Brown-McBride said the Legislature and Gov. Arnold Schwarzenegger, one of the law's sponsors, need to answer basic questions before statewide enforcement is possible. In addition to the issue of definitions -- what constitutes a park, for example, and which agencies should monitor offenders -- the questions include the law's failure to identify which offenders are covered.

How Men's Constitutional Rights Are Obliterated in Family Courts

There is a very simple trick, used all too frequently in family courts, that will almost always ensure the immediate elimination of a man's constitutional rights. Read more to find out if it can happen to you.

In acrimonious divorce and child custody disputes emotions are tense and tempers flare. Buoyed by litigious attorneys, each side engages in strategic maneuvers to gain the greatest legal advantage. Sometimes a parent, fearing a loss of control or custody over a child, crosses the ethically acceptable bounds of legal warfare.
An unfortunate but all too frequently used tactic by mothers is to accuse the father of sexually molesting their child. The mere accusation is sufficient to strip the father of all his custody rights and launch a criminal investigation.

Even when no evidence is found to substantiate the allegation, family law courts typically "err on the side of caution" and award full custody to the mother. While national statistics reveal that the majority of all child sex abuse reports are legitimate, when such claims are made by a mother in the context of custody litigation, an estimated 77% of allegations are determined to be unfounded (Tong, 2002).A false child sex abuse allegation made during child custody litigation is a destructive legal stratagem.

Throughout the world, child sexual abuse is considered the ultimate crime. Not even murder generates the kind of raw emotional reaction that results from the sexual abuse of a child. Society acknowledges the innocence of children and responds to child abusers with extreme prejudice. The power of the accusation alone is often enough for public opinion to impeach the character of the alleged child abuser and guarantee legal victory for the mother. According to Jeffery M. Leving (1997), a leading father’ rights attorney, "the use of false sexual abuse allegations to win custody suits has become almost a standard tactic among disturbed mothers and unethical divorce lawyers" (pg 148).The accused may spend years rebuilding his reputation from the monumental damage caused by the accusation.

To investigate the effect of a false child abuse accusation, a child custody survey was conducted; the group was evenly divided between males and females. A scenario was presented in which a divorcing couple was contesting custody of the children. It was stated that both parents were fit and proper. The question posed regarded what custody arrangement would be in the best interests of the child. An overwhelming 94% of respondents indicated that joint legal and physical custody, shared between parents, would be in the child’s best interest, with 78% of respondents indicating that a 50/50 time sharing agreement was appropriate. Another scenario was presented.
In the second scenario the father has been accused by the mother of sexually molesting their child. The Department of Social Services and the police conducted an investigation and concluded that there is insufficient evidence to determine whether or not the father committed sexual abuse. The question of custody is again asked.

As a result of the unsubstantiated accusation against the father, 79% of the same respondents stated that sole legal and physical custody should be granted to the mother. Only 15% of respondents felt that the father should be permitted a minimum of 50% visitation with the children. In the final survey question regarding the respondent’s personal opinion of child molesters, 42% stated that they should be "locked away for life" and 48% responded that they should "burn in hell".

Why do so many mothers file false sexual abuse allegations during custody cases? They work. False accusers in this type of case rarely face prosecution.

The judicial system, likewise, responds to alleged child abusers swiftly and aggressively. Unfortunately for many falsely accused fathers, truth and justice are often niceties which are frequently ignored. Leving (1997) writes, "Based on well-meaning ‘better safe than sorry’ policy, abuse investigators often accept an abuse charge as fact and consider the accused abuser guilty until proven otherwise" (pg 150).

This is a significant problem. The US Constitution guarantees that accused persons are to be treated as innocent until proven guilty. In this type of case, however, constitutional safeguards are abandoned. The burden of proof falls upon the accused to prove a negative, or, to conclusively show that an alleged event never occurred. This reversal of constitutional jurisprudence sets a dangerous precedent and ensures the conviction of many innocent men. The destructive power of a false child abuse allegation has been termed "the nuclear option" by law professionals (Tong, 1997).

Once this nuclear bomb is dropped, all hope of civil reconciliation is lost. The custody battle escalates into a bitter war.
The prevalence of false accusations is a matter of debate. Disagreement over the proper ratio of false abuse statistics may range anywhere from 20% to 80%.It can be extremely difficult to correctly track the ration of true to false accusations because of the problem in identifying the intent of the accuser.

In some instances a mother genuinely believes abuse has occurred. In other instances the mother may not be sure and simply doesn’t know what to do other than to file an allegation of abuse. However, when one considers all factors, including the number of retracted allegations, recantations and the preponderance of cases proven to be dishonest, a fair estimate settled upon by many studies is an average of 77% (Brennan & Brennan, 1994).

False reports of sexual abuse against children are often first reported to Child Protective Services (CPS) or some other governmental social service agency. A safety assessment is conducted by a CPS or social worker (Ney, 1995). During this brief assessment standard questions are asked of the mother regarding the alleged event. At the end of the assessment, even if no proof of wrongdoing is presented, procedure requires the social worker to recommend that full custody be given to the mother as a safety precaution until a full investigation is concluded.

This assessment is included in an official complaint and presented to a district court judge. The judge will typically grant an Emergency Ex-Parte Order giving the mother temporary sole custody of the children and restrain the father from having any contact with his children, even when no additional evidence beyond the mother’s word exists. A hearing date is set and the legal battle begins.

The mother gains immediate advantages over the father. First, by giving the mother full custody of the children the court is setting a precedent that will be hard for the father to overcome. Most family court judges believe in maintaining the status quo, and subsequently order the children to continue residing with the mother rather than changing the children’s residence to that of the father (Hardwick, 2004).A second advantage for the mother is that the children are unable to communicate with their father and a process of alienation begins. The more time that passes without contact, the greater the alienation. During this period of alienation, a child may be coached by the mother to support the allegation against the father.

After the Emergency Ex-Parte Order has been granted, an investigation of the allegation begins. As part of the investigation, the child is examined by a medical doctor for physical signs of sexual abuse. It is rare that evidence is discovered. The child is also seen by social workers who use items such as anatomically correct dolls to try to encourage the child to talk about what happened.

Even when the child states that nothing happened, the investigation continues. After a series of interrogations, which often serve to reinforce the false story in the child’s mind, the child may eventually say something or play with the dolls in such a way as to cause the social worker to suspect abuse (Tong, 1992).As part of this ongoing investigation by both CPS and local law enforcement, the reputation of the father is constructively destroyed by the investigation. Family relationships become strained. Employers tire of granting time off work to accommodate the father’s frequent court hearings. Social relationships are damaged, often never to be repaired.

The very process of being investigated causes many men to give up and grant the mother everything she wants from him. Sadly, many fathers are so traumatized by the horror of the process that they commit suicide (Seidenberg, 1997).False abuse expert, Dean Tong (2002), says of the emotional state of the accused:Sleep is forever elusive, night-terror becomes common-place and depression is a constant companion.

Rarely is there any support to be found within the community and rarely is there any sympathy for the falsely-accused. Throughout it all, you must bear the title "abuser," until you prove otherwise, if you can. Disorientation, denial, shock, confusion, anxiety, and disbelief are constant. Lack of concentration is a chronic problem, exceeded only by the frustration of being denied the right to see your children.

Immediately, the father finds himself in a maze of confusing litigation. He spends thousands of dollars to retain an attorney. Police often request the father to take lie detector tests. Even though he submits to and often passes several polygraph tests, it does him little good as the tests are not admissible in court. A single attorney is rarely sufficient to provide an appropriate defense in this type of case.

Thousands of dollars must be spent to retain psychologists and other expert witnesses in the fields of sexual abuse. In an attempt to prove their innocence, many fathers submit to invasive psycho-sexual testing, such as the penile polygraph. In this particular test sensors are placed around the penis and variety of video images are displayed to the father, such as children playing in water or little girls in bathing suits.

The subtlest of sexual responses while looking at images of children will condemn the father. The cost of testing, attorneys, expert witnesses and other legal fees in this type of case often exceeds $50,000.The father sometimes has to mortgage his home and sell his assets to afford a sufficient defense. Naturally, little money is leftover at the end to use in a custody case.

In most court districts throughout the United States, judges run for office as any other politician. If a judge takes, or fails to take, an action that leads to the abuse of a child by an alleged child abuser, his political career may be over. Political expediency is a strong, yet unspoken, factor in emotionally charged cases such with child sexual abuse (Seidenberg, 1997).

When a father has been falsely accused of molesting his child, even when no evidence substantiates the claim, he often loses custody of his children because the court decides to "play it safe". The father may not go to jail, but the temporary order preventing his access to his children is frequently made permanent.

By no fault of his own, the father has lost his children, all because a mother chose to fight dirty in court. For the unfortunate father who loses his criminal case, he is locked away. Sentencing for child molesters is typically longer than sentencing for murder (Seidenberg, 1997).Men convicted of child molestation are constant targets of prison abuse by fellow inmates. Fathers, unjustly incarcerated, become bitter and less productive members of society.

The father is not the only victim in a false child sex abuse allegation. Children are also victimized. Not only does the child have to submit to numerous interrogations and invasive tests to determine if abuse occurred, but needless therapy is often prescribed. The child, knowing at first that nothing happened, is subjected to counseling that reinforces the story that abuse has occurred. In time, many children grow to believe and accept that their fathers molested them. The emotional trauma is life-long.

This phenomenon has become so common that psychologists have given names to the syndromes that result from false abuse claims, including Parental Alienation Syndrome (PAS) and Sexual Abuse in Divorce (SAID).The allegation is, in itself, a form of child abuse (Wexler, 1990).The loss of self-esteem, the destruction of the father-child relationship, the mental and emotional damage and premature sexualizing of the child are all very real results of a false abuse accusation. Children who grow up believing they were sexually abused often develop deviant sexual interests and proclivities. No child should be treated so heinously by parents embroiled in a legal chess game.

A false child sexual abuse allegation, while usually ensuring the legal victory for the mother, is destructive to all parties involved. Child molestation is a terrible crime and false accusations play on the natural prejudices of society to the extent that victory can almost be guaranteed for the accuser. The loss of fathers in the lives of their children has many negative consequences for society as a whole.

Laws need to be passed that protect the rights of the accused as in any other type of trial. Penalties for false accusers must be created and imposed. Social workers, judges, and others involved in the investigation of this type of allegation must be taught the syndromes that affect children when a false abuse claim is made. Sexual abuse claims made in the middle of custody proceedings must be viewed with some skepticism. Judges must be made aware of the usefulness of certain scientific tests, not currently admissible in court, which may help to vindicate the accused.

Finally, an emphasis on more stable families will lead to fewer divorces, and, therefore, fewer false abuse claims. Until these, and other, reforms take place, innocent children will continue to be used as pawns in a senseless game of legal strategy.

Sex Offender Who Owned Home, Committed Crime Before Residency Law Passed Not Required to Move

2-20-2008 Ohio:The Supreme Court of Ohio held today that, because a 2003 state law barring certain sex offenders from residing within 1,000 feet of a school does not expressly provide that its provisions apply retrospectively, the statute does not apply to an offender who bought his home and committed his crime before the law took effect. The 6-1 decision was authored by Chief Justice Thomas J.

Moyer.Because the Court found that the residency statute does not apply retroactively, the justices did not reach or decide the issue of whether such a law, if expressly made retroactive by the legislature, would violate the Ohio Constitution’s prohibition against retroactive laws that infringe on an individual’s substantive right.The case involved a challenge by Gerry Porter to R.C. 2950.031, a state law effective on July 31, 2003, that prohibits certain sexually oriented offenders from “establishing a residence or occupying residential premises” that are within 1,000 feet of any school property.

Porter purchased a home in 1991 where he lived with his family for 14 years. He was required to register as a sexually oriented offender following his conviction of a sexual battery charge in 1999. Following the legislature’s enactment of the sex offender residency statute, Green Township chief legal officer Francis Hyle sought a court injunction to force Porter to move out of his home because a portion of his property was within 1,000 feet of school premises.

Porter opposed the injunction, arguing that the residency statute was unconstitutional as applied to him. The Hamilton County Court of Common Pleas issued an injunction requiring Porter to move out of his house. On review, the 1st District Court of Appeals affirmed the action of the trial court. However, the 1st District also certified that its decision in this case was in conflict with a 2006 decision by the 2nd District Court of Appeals, Nasal v. Dover, in which that court found the residency restriction was unconstitutional because it retroactively infringed on a sex-offender’s vested right to live in a home he had purchased before the “1,000-foot rule” became law in 2003. The Supreme Court agreed to hear arguments in the case to resolve the conflict between appellate districts.

Writing for the majority in today’s decision, Chief Justice Moyer noted that the Supreme Court’s decisions in Van Fossen v. Babcock and Wilcox Co. (1988) and State v. Consilio (2007) have established a two-part test for reviewing challenges to the retroactive application of a law.

Under this test, we first ask whether the General Assembly expressly made the statute retroactive,” Moyer wrote. “If it has, then we determine whether the statutory restriction is substantive or remedial in nature. ... We do not address the question of constitutional retroactivity unless and until we determine that the General Assembly expressly made the statute retroactive.”Applying the first prong of the test, the Chief Justice cited a rule of statutory construction set forth in R.C. 1.48 that “(a) statute is presumed to be prospective in its operation (i.e., to apply only to events that take place after the effective date of the law) unless expressly made retrospective.” He wrote: “In order to overcome the presumption that a statute applies prospectively, a statute must ‘clearly proclaim’ its retroactive application. ... Text that supports a mere inference of retroactivity is not sufficient to satisfy this standard; we cannot infer retroactivity from suggestive language.”In analyzing R.C. 2950.031 under that standard, the

Chief Justice rejected arguments by Mr. Hyle that statutory language referring to a person who “has been convicted of” specified categories of sexual offenses and prohibiting such a person to “occupy residential premises” clearly indicated legislative intent for the restriction to apply to a convicted sexual offender who committed his offense and lived in his house before the residency law was enacted. He pointed to wording in two other Ohio statutes as examples of clear and unequivocal language indicating the legislature’s intent that those laws be applied retroactively.

“Both former R.C. 4121.80(H) and former 2950.09(C)(1) expressly make their provisions applicable to acts committed or facts in existence prior to their effective dates. In addition, R.C. 4121.80(H) expressly proclaimed its applicability in spite of contrary preexisting law by including the phrase, ‘notwithstanding any provisions of any prior statute or rule of law of this state,’” wrote Chief Justice Moyer. “These examples demonstrate that the drafters of legislation know the words to use in order to comply with the Ohio Constitution and the requirement created by the General Assembly (R.C. 1.48). The text of R.C. 2950.031, by contrast, does not feature a clear declaration of retroactivity in either its description of convicted sex offenders or its description of prohibited acts.

The statute does not proclaim its applicability to acts committed or facts in existence prior to the effective date of the statute or otherwise declare its retroactive application. In the present case, the absence of a clear declaration comparable to the two excerpted above precludes the retrospective application of R.C. 2950.031.” Chief Justice Moyer’s opinion was joined by Justices Paul E. Pfeifer, Evelyn Lundberg Stratton, Judith Ann Lanzinger and Robert R. Cupp.

Justice Maureen O’Connor concurred in judgment only.Justice Terrence O’Donnell dissented, stating that in his view the plain language of R.C. 2950.031 does clearly indicate legislative intent: 1) that the 1,000-foot residency restriction be applied to sex offenders regardless of whether their crimes were committed before or after the effective date of the statute; and 2) that covered offenders be barred both from “establishing a residence” and from “occupying residential premises” that are within 1,000 feet of a school after July 31, 2003 – regardless of whether an offender “occupied” those premises before the law was enacted.“If the General Assembly had intended only to prohibit individuals from establishing a residence within 1,000 feet of a school after its adoption of this statute, it did not need to also prohibit those individuals from occupying residential premises – but, it did so,” wrote Justice O’Donnell. “The General Assembly, in choosing to prohibit both the establishment of a residence and the occupation of a residential premises, intended to preclude present and future conduct regarding the location of a residence of persons described in this statute; and it did so by using language to preclude both establishing a residence or occupying one.

Justice O’Donnell added that, having found clear legislative intent that the challenged statute be applied retroactively, he would go on to hold that the 1,000-foot residency restriction is remedial rather than substantive in nature, and therefore that retroactive application of the statute to require Porter to vacate his home did not violate Porter’s rights under Section 28, Article II of the Ohio Constitution. ..more.. A Sourtheast Portland-based online group blurs the lines between profits and justice

Xavier Von Erck and his Southeast Portland-based online group Perverted Justice are perverted all right. Formed in 2003, the ironically named group, which is mostly staffed by volunteers, trolls internet chat rooms looking for "would be" pedophiles and induces them to commit a crime.

The men are enticed into having sexually explicit conversations with what they believe to be underage girls. If the Perverted Justice member, posing as a minor, is good enough, they'll convince the man to meet them at a decoy house where law enforcement agents will be waiting to arrest them.There is no denying that pedophiles are terribly sick individuals who should be strongly punished for any offenses they commit. But where does one draw the line between a fantasy and an actual illegal offense?

Perverted Justice, with the help of law enforcement agencies and recently NBC and other news organizations, has made that judgment call. Once a person-usually a man-intends to commit a lewd act upon a child, they are in violation of the law and can then be arrested and prosecuted. It seems a fair enough idea that pedophiles be apprehended before they have the opportunity to harm a child. But are the men that Perverted Justice is helping catch and prosecute actually criminals?

Many believe they are not. In a recent article in The Oregonian, Lynn Davenport, a former child protective services worker, suggests that few of the men that are caught through Perverted Justice have ever abused a minor. It is also suggested that these stings divert attention and resources away from real child abuse. So what it breaks down to is these men have pedophilic desires, they find themselves in a position to potentially act on them and are enticed to do so.

But they never actually harm a child. One could assume that without provocation most of these men would never have acted upon their perverse attractions.Law enforcement stings of this type are becoming more popular throughout our country. In some cities, there are officers who go undercover and pose as couples and park in front of a convenience mart or such and leave their car running while they go inside. Sometimes someone will take the bait and get into the car and attempt to drive off. This is when tens of police swarm and arrest the perpetrator.

It's bad enough that people who are provoked into crime are being punished in place of the opposite. And these sorts of sting operations beg questions from the public like: Don't our law enforcement agencies have anything better to do than to trick people into committing crimes? Aren't there enough criminals out there, ones who don't need to be tempted into crimes by undercover officers, to arrest?

The answer to those questions presumably is that stings of this type are feel-good operations for police. They get to go out there into the criminal element and get their hands dirty. They play the role and at the end of the day they're the good guys. They can actively feel like they made a difference and were able to get one more criminal off the streets.

Never mind they might have caught someone who may have gone their entire life without committing a crime of that nature. That without that one single perfect instance that the police have created and provided for them the person may have remained completely law-abiding. But since they actually did commit the crime, regardless of police involvement, they can be prosecuted.

Whether you agree with that reasoning or not there is something more sinister to Xavier Von Erck's Perverted Justice group and their new affiliates NBC and MSNBC. With shows like To Catch A Predator the networks have proven that there is a profit to be made off of the depiction of the bait and then capture of these men. Even our local Fox affiliate news station here in Portland, Fox12, has teamed up with Perverted Justice to produce segments in their evening news that boils down to nothing short of petty harassment.

In these segments called "Operation Cyber Sting" a Fox12 news crew will be waiting with police at a decoy home and when the man is arrested he is forced in front of bright lights and cameras as a reporter attempts to interview them about the offense. This is when the departure from criminal justice into irresponsible and distasteful entertainment occurs.

Whether Perverted Justice was started with the best intentions or not is irrelevant. Its message has been corrupted and perverted by money. Xavier Von Erck, a man who admits to not liking children at all, could be commended by his intentions but should instead be ashamed for what his organization, through affiliation with NBC and others, has devolved into.

A profit should not be derived from the capture of criminals, especially when the moralistic lines can be so differently interpreted. These operations, in the views of many, are blurring the lines between true guilt and intention. Not only that but they compromise our justice system's founding belief that one is innocent until proven guilty.

Believe it or not there was a time when integrity used to be valued more highly than money. But those days are apparently long since dead.

{OUCH!!! There have been several articles over the past weeks and months that are growing downright "Hostile" toward "Baron von geek" and his band of merry pranksters at perverted Justice.
I guess suicide and lawsuits are not the stuff of "must see TV"? Is this yet more evidence that the "sex offender" ratings boom is coming to an end?

When Journalist turns on Journalist/entertainer have we reached some crossroads? NBC has been paying out Millions to advertiser's because of recent low ratings. I bet there have been more than a few meetings that discuss how they want to do more stings with PJ to change the trend but they are now forced to weigh that against pending and potential lawsuits and at least one suicide.

PJ has thrived by hiding out on the net as they attack from a distance. The problem is that many people are now standing up to their tactics and flushing the "cyber troll's" out of their hiding places and holding them accountable thru lawsuit's civil and criminal. PJ's leader "Baron von geek" does not do well in an open forum.

He prefers to attack anyone that oppose's or even questions him about his tactic's on a personal level thru the internet away from the preying eyes of the law or the general public. He will send out his minion's to post flyers in your community that proclaim that you are a pedohile.

They will call and harass your place of employment as well as any friends and/or family that they can track down in order to silence you. Can anyone else smell the fear in the air?

More and more media outlets are coming out against PJ as well as some very courageous advocates that have had to suffer thru the PJ attack machine if they "DARE" to question the tactics or methods of Perverted Justice.

It's like watching a cornered animal lash out in desperation. Baron von nerd is not a confident childrens advocate he behaves like a spoiled child who's every whim has been indulged but now has to make his own way in the real world.}

Aldermen reject sex-offender housing ban

Manchester – Aldermen yesterday said no to a proposal that would have banned registered sex offenders from living near schools, parks and other places frequented by children.
The measure was unanimously rejected by the Public Safety, Health and Traffic Committee at the urging of the city's police department.

Deputy Police Chief Marc Lussier and officers in the juvenile division argued the restrictions would not prevent offenders from committing another crime, and could drive some offenders into homelessness.

"Having residency restrictions is not going to be the answer," Sgt. Scott Fuller said.
Leo Pepino, the former alderman who has lobbied hard for a measure that would keep offenders away from children, said he plans to take the fight directly to the full Board of Mayor and Aldermen.

"I'll keep working to get a couple more (votes)," he said yesterday.
The committee's vote was yet another defeat for anti-crime activists who hope to restrict the number of places where registered sex offenders can live. A similar proposal in Nashua was recently vetoed by the outgoing mayor, Bernie Streeter.

At least five communities in New Hampshire have adopted residency restrictions in recent years. Officials in Derry have said they would consider a proposal to keep offenders out of certain neighborhoods after it was revealed a man convicted many years ago of killing a child was living near a school. The man has since moved out of the state.

Pepino said the scare in Derry should convince people that restrictions are needed.
"If they had had a residency (restriction) like this, he wouldn't have been there in the first place," Pepino told the aldermen.

Roughly 300 sex offenders on the state's registry are living in Manchester, police said. Fuller said the department currently requires each offender to come by the station twice a year to update his or her registration.

In addition, he said, officers in the juvenile division try to stop by each offender's home as many as three or four times each year to confirm he or she is living at the listed address.
With a compliance rate of 97 percent, Fuller said, "the current system is working." Police say as much as 90 to 95 percent of all sexual assaults are committed by people who know the victim.
In seven years with the juvenile division, Fuller said, no more than four convicted offenders were arrested for committing another sex crime. In all cases, he said, the victim was known to the assailant.

"There are very few stranger attacks, per se," he said.
All five members of the public safety committee voted to receive and file. Members are Bill Shea, Russ Ouellette, Dan O'Neil, Jim Roy and Peter Sullivan.

"I don't think the citizens and young people of Manchester can be protected more than what our police department is already doing," O'Neil said.

Committee members said they hope to find extra money for the police department, so officers can do more compliance checks than they already do. Fuller said the department currently averages about 15 compliance checks a week, depending on its case load.

{Well the tide is definitly starting to turn. Small towns with small budgets and small police forces all across the country have had to do the math as they are faced with passing costly proposals.

The problem is they simply cannot afford to "grandstand" so that some alderman can get re elected. Also in some "rare" instances the small town city counsel actually goes to the sheriff or chief and ask, what do you think? This kind of small town government has to be efficient.

They have the facts and statistics now in regards to RSO recidivism as well as the opinion of their town sheriff, then they weigh the facts against whatever political gain might be achieved come re election time then they add the cost of implementing a program that will do absolutely "NOTHING" to protect anyone from anything.

More and more RSO restrictions are going down in flames in small town's that have to face facts. The RSO political "goldmine" has finally tapped out and the vacuum will slowly have to be filled with common sense and truth.

My local sheriff's deputy thinks that the RSO laws make no sense however the state's sheriff's association endorsed the passing of the AWA act. Was my deputy in the minority? I am afraid that the answer can be found if you simply follow the money.

The AWA act could potentially lead to the hiring of hundreds of extra sheriff's throught the state which means more influence and power at the state level not to mention a growing union base and a larger slice of the budget pie.

It has nothing to do with the opinions of the deputy's that are charged with enforcement and has absolutely nothing to do with keeping children safer.

It's to bad that the taxpayers of my state have to pick up the tab for politicians that are far from the cutting edge when it comes to programs that waste money and accomplish nothing. The Political gold has panned out but their just to far behind the curve to see it.}

More "BAD PRESS" FOR NBC

There's something that bothers me about NBC Dateline's "To Catch a Predator," a journalistic sting operation where volunteers pose as 12- or 13-year-olds in online chat rooms, baiting sexual predators into graphic sexual conversations and eventually getting the men (they are always men) arrested on national TV when they come to the decoy's house looking for sex.Certainly, as host Chris Hansen frequently notes, the program does a major social good by identifying potential sexual predators and getting them off the street. And it is difficult to summon sympathy for a man (and they are always men) looking to have sex with a 12-year-old. But it seems to me that there are major questions of ethics that cannot simply be waved off with "the ends justify the means."For starters, the decoys themselves are usually the leaders in the conversation: the first to bring up the subject of sex and later the ones who invite the men over to their house to have sex.

The nature of statutory rape, of course, is a unique one insofar as it is illegal even when all parties involved "consent," but the law was originally designed with the understanding that adults have the ability to sway a child's mind in an unfair way, to take advantage of their intellectual naivete and pressure them into sex.

Or alternatively, that the child understands so little of what is going on that it is literally impossible for them to actually consent to sex and all its implications.Neither of those situations seems to apply here. Let's not confuse the predators with child rapist. From the predator's point-of-view, he isn't chatting with an innocent child who doesn't understand what is going on, he's chatting with a child who seems to have astoundingly graphic sexual knowledge, willingly and eagerly engaging in lewd chats to the point of coyly inviting and begging the adults over to have sex.

There is a serious difference between raping a child, manipulating him or her into having sex and giving into to your pedophilic sexual desires when confronted with a child almost demanding you fulfill your deepest sexual fantasy.

All three of those situations are still illegal, of course, and it very well should be. The adult always bears the responsibility to recognize the horrifying situation and take a step back. But sometimes the sting operations involve men who, as Chris Hansen admits, arrive at the house having engaged in chats that are inappropriate but perhaps not necessarily illegal. Hansen insists that such men are "usually" not shown on TV - usually?

Dateline's power of public humiliation is a punishment greater than anything the criminal justice system would have ever meted out. And besides, should the decision to do so rest with a television program, one whose primary purpose is ratings and advertising revenue?What I find most distasteful is that Dateline is exploiting these people's very deepest, most primal sexual urges in enticing them to commit this crime. Imagine a spin-off show, "To Catch an Adulterer," that featured women baiting, pleading, begging husbands to cheat on their wives with them, and then arresting them, humiliating them on national TV. Adultery is a serious crime, but surely not even the most upstanding of men - not even Chris Hansen - could withstand such temptation. AUSTIN — Normally get-tough Texas lawmakers are among scores of state officials and victim's advocates blasting a new federal law they say is unfairly harsh on some of the youngest sex offenders.

Criticism of a national sex offender Web site that would require juveniles as young as 14 to register is mounting as states face a July 2009 deadline to enact provisions of the bill signed by President Bush.

States that do not comply risk losing millions of dollars in criminal justice funding, but the law's no-exceptions scope for some young offenders is giving many Texas officials pause.
"We think our laws are strong enough," said Sen. Florence Shapiro, a Plano Republican and a leading advocate of sex offender registration laws in Texas.

Under the Adam Walsh Child Protection and Safety Act of 2006, states must participate in a national sex offender registry. Critics say the registry puts juveniles who engage in consensual sex with children younger than 13 in the same category as armed rapists and pedophiles.
The Justice Department is expected to issue final guidelines of the law this spring.

Juveniles are included in Texas' sex offender registry, but the state gives judges broad discretion in deciding which ones are placed there. Judges would lose that discretion under the federal act.
"There are an awful lot of sexual assault cases, and then there are kids who engage in sex at an early age," said Bill Hawkins, chief of the juvenile division of the Harris County District Attorney's Office. "The Adam Walsh Act wants to put them all together."

The problem, according to critics of the law, is that the registry doesn't factor the risk level of the offender. Juvenile sex offenders are said to be more capable of rehabilitation, and studies have shown than less than 10 percent of juveniles who commit sex offenses re-offend as adults.
More than 47,000 people are listed on the state's sex offender registry.

Of those, 275 are younger than 18 and 3,853 are registered based on offenses they committed as juveniles, according to the Texas Department of Public Safety.

State Rep. Jim McReynolds, D-Lufkin, initially championed the Adam Walsh Act. But he now believes the law makes little financial sense for Texas, arguing it would cost local communities more to enact the stringent requirements than what the state would earn through compliance.
"It's a financial loser ... an unfunded mandate," he said.

{Well "Hang em high" Texas has finally weighed in on the Adam Walsh Act. It can only be seen as good news that the state the largest number of executions has scoffed at the implementation of the Adam Walsh Act.

Politicians on both sides of the isle have weighed in against AWA citing concerns over juvenile inclusion but also over the huge costs involved.

Its a financial LOSER? An unfunded mandate? I hope some of the other States are watching whats going on in Ohio and Texas.

Congress is going to have to pay alot more bribe money to the states to get anything near full compliance.

That's kind of hard when you have a war to fight and with all the pork that must be paid out in order to get the congress and senate to vote the way you want.

Sexual Offender Programs

The Correctional Service of Canada's (CSC) Sexual Offender Programs are primarily focused on male offenders who have been identified as a result of their offence history.
Two programs are delivered nationally; the Moderate Intensity Sex Offender Program (NMISOP) and the Low Intensity Sex Offender Program (NLISOP). Offenders are referred to the programs based on their risk level and need as assessed by a specialized sex offender assessment. Both programs were accredited by an international panel of corrections experts in June 2000.

The programs are delivered according to Correctional Program Standards. The National Sex Offender Program Guidelines also give useful clarifications in regards to program implementation (selection criteria, program director role, etc.). As well, the programs include a detailed evaluation process that permits a comprehensive program evaluation and outcome analysis of the program's success in reducing the thinking and behaviours associated with sexual violence.

National Moderate Intensity Sex Offender Program
The National Sex Offender Program is a cognitive-behavioural intervention that is designed to be a therapeutic, rather than solely a didactic or psychoeducational program. It is based on empirical research and best practice in the provision of services to sex offenders, and on the principles of social learning, adult learning, group processes, therapeutic rapport and alliance, motivational enhancement, overlearning, and skills development.

The National Sex Offender Program targets criminogenic needs and known risk factors for sexual offending. The format of the National Sex Offender Program uses a "menu" approach based on criminogenic needs and known risk factors associated with individual offenders' patterns of sexual offending behaviour. In the National Sex Offender Program, the client is regarded as the "expert" about his own behaviour and, as such, the role of the service provider is to assist the client to develop, through guided learning, an awareness of the dynamics and motivations of his sexual offending behaviour and to develop a self-management plan to avoid re-offending. The National Sex Offender Program also incorporates both group and individual work, and recognizes learning that occurs outside the formal treatment venue.

Referral Criteria
The Sex Offender Program is intended for all federal offenders who:
Have been convicted of a sex offence or;
Have been convicted of a sexually motivated crime or;
Have admitted to a sex offence for which they have not been convicted.
AND
Offenders having a moderate risk to re-offend relative to other sex offenders, as assessed using a sex offender-specific actuarial assessment instrument such as the Static-99
Offenders who have moderate to high criminogenic needs as assessed using a sex offender specific measure of dynamic risk factors such as the Stable-2007 (moderate to high need levels refers to both the number, type, and extent of entrenchment of dynamic risk factors).
Selection Criteria

The Moderate intensity program is designed for offenders assessed as moderate risk to offend sexually and with need levels that are either moderate or high. Moderate to high need levels may be based upon evidence that the offender has multiple criminogenic needs associated with sexual offending behaviour. For example, an offender whose sexual offending behaviour is associated with several domains, such as attitudes supportive of sexual aggression, deficits in social competence or skills, impulsivity, and empathy deficits, may be assessed as having moderate to high need levels and should receive treatment designed to address these criminogenic needs.

Alternatively, offenders may be assessed as moderate to high need as a result of deficits in fewer domains, but which are particularly well entrenched or influential on behaviour. For example, offenders whose sexual aggression is associated with well-entrenched attitudes supportive of deviant sexual behaviour and with frequent deviant sexual fantasy, may also be assessed as moderate to high need.

Methodology
The Moderate Intensity National Sex Offender Program is structured to require approximately four to five months to complete. There is a minimum requirement of 10 hours of group work per week, with a maximum of 14 hours per week. Additionally, service providers conduct a minimum of two individual sessions with each offender during the course of the program. The program is conducted with two service providers.

Continuum of Service/Maintenance Programming
The final phase of the Moderate intensity program is maintenance programming that is offered as a component of the program. This component is designed as a follow-up to treatment intervention, and is to be offered to all sex offenders completing the moderate intensity program. Maintenance is conceptualized as a component of treatment, rather than as a separate program, to emphasize the importance of follow-up and continuity of service to sex offenders, as well as the importance of continuity of care between the institution and the community. In maintenance, clients review and reinforce their self-management plans (and release plans, if applicable) to entrench these plans and strategies and to revise these in light of changes in circumstances.

Maintenance in the institution is designed to assist offenders in maintaining treatment gains and to revise their self-management plans. In the community, maintenance also performs these functions, but also continually reassesses risk and dynamic risk factors to assist in supervision. In the community, sex offenders should have a comprehensive self-management plan which outlines their high risk situations, triggers to sex offending, and behaviours that parole officers and program officers would observe in the community if an offender's risk was increasing. These should be clearly delineated in the self-management/release plans and should be reassessed on a continual basis.

Low Intensity National Sex Offender Program
Low intensity is a structured cognitive-behavioural, process-oriented group that allows offenders to individualize, integrate, and enact other aspects of the treatment experience and treatment topics. The long-term goal of treatment is to maintain the risk of offending at a low level and/or to reduce risk. The foundation for low intensity treatment is the self-management of behaviour that may place the offender at risk to reoffend. Clients are assisted in developing an understanding of their risk factors and potential pathways to re-offending based on an analysis of past offences.

Through this analysis, service providers assist clients to identify dynamic risk factors relating to their offending behaviour, after which clients formulate risk self-management plans.

Note that these are general guidelines based upon research pertaining to sexual offenders and are not inclusion criteria.

Methodology
The Low Intensity Sex Offender Program is approximately two to four months in duration. There is a minimum requirement of 3 hours of group work per week, and a maximum of 5 hours per week. Individual intervention is conducted as required. Groups may be led by one or two service providers depending upon the needs and size of the group.

{Well as much as I hate to admit it Canada is 20 years ahead of the United States when it comes to actual SOLUTIONS for people that commit Illegal sexual acts. First of all they do not base their solutionsto these problems with guilt and shame based legislation.

I think its time we took a few pages from the Canadian play book as far as the massive failure our current RSO laws are creating. Law aims to monitor Web use by sex offenders

To better protect the public, sex offenders might soon have to provide corrections officials details about their e-mail addresses and Internet accounts, such as MySpace.

A state legislator has introduced the Sex Offender E-Disclosure Act that would require people on the state sex offender list to register every e-mail and Internet address they maintain for personal, family or household use. The State Department of Corrections already requires a sex offender's fingerprints, photo, address, place of employment and the name of the school they attend.

"Ultimately, the Internet is like any other place of association," said Lena Taylor, D-Milwaukee, who authored the Senate version of the bill. "Like schools or residential areas, it's a forum where sex offenders (make) contact with other people. It makes sense, then, that we take the same precautions with the Internet that we take with our schools and neighborhoods."

Mike Williams, field supervisor for the Marathon County Community Corrections division, said corrections agents already monitor the Internet looking for people who are breaking the rules of their probation or parole. Most sex offenders are barred from using the Internet while under direct supervision of parole agents and only can use it after they have completed their sentences.

There are 247 sex offenders listed on the state registry with ZIP codes in Marathon County.

Wausau Police Chief Jeff Hardel said it is important to know where sex offenders are and what they are doing.

"It does appear that the recidivism rate for these individuals is very high," Hardel said. "We have dealt with this population on a fairly regular basis."

Williams speculated that a person who fails to update officials about their Internet sites could be placed back on probation. That already happens a couple times a month when people fail to update their addresses, he said.

HARTFORD, Conn. - In addition to height, weight, address and willingness to be an organ donor, more driver's licenses across the nation include another piece of information _ whether the carrier is a registered sex offender.

It's part of a growing effort by state policy-makers to help police keep better tabs on pedophiles, rapists and others who must sign up with state-run, offender registries and compel them to comply with restrictions on their whereabouts.

Connecticut Gov. M. Jodi Rell this month proposed a new law requiring registered sex offenders to obtain a driver's license or state identification card that includes a code identifying them as a sex offender.

"It just gives the police department another tool, something else they can use," she said. A similar law took effect in Florida on Aug. 1. In that state, IDs feature the number of each state statute that the offender violated on the bottom right corner. Florida officials hope to finish updating the cards of sexual offenders and predators by this month.

"If you didn't know about the statute, you wouldn't know what that is," said Ann Nucatola, a Florida Department of Highway Safety spokesman. Other states make the carriers' crimes more clear to an untrained eye. An Oklahoma law that took effect in November calls for driver's licenses and ID cards to display the words "sex offender" in three places. Offenders are required to renew the cards annually.

Louisiana, Alabama, Mississippi and Delaware also have laws requiring registered sex offenders to carry identification that identifies their status, the U.S. Government and Accounting Office said. West Virginia and Kansas both require state ID cards or licenses to include the information, but don't require offenders to obtain the IDs. In Connecticut, it's uncertain if Rell, a Republican, will succeed in pushing the bill through the Democrat-controlled legislature. Some lawmakers are already suggesting the proposal goes too far and could hamper offenders' efforts to find jobs and housing after leaving prison.

"It's so far-reaching," said Rep. William Dyson, D-New Haven, who has worked to pass legislation that helps ex-offenders reintegrate into society. "We don't put a brand on murderers, people who've killed someone." Rell said the designation would be as innocuous as the code that identifies if a driver should wear corrective lenses. "It's not like, you know, the scarlet letter or anything like that," she said. "If you have some identifying tool on that driver's license, how different is that than anything else that's already on there now?

" Dyson said it won't take long for the public to know what the designation means. "I'm not about the business of defending sex offenders. But what does that do to all us eventually?" he asked. "We're going to create this colony of people that are going to be so far outside the mainstream."

Harnett Woman Gets Plea Deal in Teen Sex Case

Lillington — A Harnett County woman has been placed on probation after pleading guilty to having sexual encounters with two teenage boys.

Crystal Rodriguez, 26, initially was charged with three counts of statutory rape and faced up to 57 years in prison. She reached a plea deal with prosecutors this week, however, and pleaded guilty to two counts of sexual battery, a misdemeanor.

Rodriguez was accused of having sex with a 14-year-old boy and improperly touching his 13-year-old brother. The incidents occurred in 2006 at her home, authorities said.

Superior Court Judge Frank Lanier said he accepted the deal based on the recommendations of the Harnett County District Attorney's office. Prosecutors were acting at the request of the victims and their family, who wanted Rodriguez to get mental health treatment and not jail time.

"The reason this plea was given was because the victims did not want Mrs. Rodriguez to go to jail. The victims were adamant that leniency be shown to Mrs. Rodriguez," defense attorney Jason Wunsch said.

Harnett County Assistant District Attorney Teresa Postell, the prosecutor who handled the case, declined to comment.

Rodriguez will spend at least two years on supervised probation, during which she must complete 48 hours of community service and undergo a psychiatric evaluation to determine if she should enroll the state's sex offender program, which would provide counseling.

She also must register as a sex offender and will be prohibited from any unsupervised contact with anyone under age 16, except for her own children.

Wunsch said he doubted Rodriguez's gender played a role in the plea deal. He noted she had no prior criminal record and is married with two small children.

"This is the first kind of trouble that she's ever faced with the law. I think, therefore, that the sentence is appropriate and adequate," Wunsch said.
"I know that the state's foremost priority was the victims in this case, seeing that they got healing, and I know that the state spent an extensive amount of time talking to the family and that this is what they wanted," he said.

Rodriguez issued an apology to the boys and their family.
"I would like to say that I'm sorry for everything that has happened," she said. "All I really want is to go ahead and start the healing process, and hopefully they'll be able to move on with their lives, and I can move on living my life."

Rodriguez said her family has been very supportive, and she thanked prosecutors for offering a plea deal.
"If it weren't for the state of North Carolina, I wouldn't be here with my children right now," she said.

{Well who in the RSO community could not get a thrill out of a news story like this? NBC has "whored" itself out to pervjustice.com in the name of ratings and profit with the so called "to catch a predator" series.

Their house of entrapment and lies has emploded in a dramatic way over the past 6 mos. With the Murphy TX incident along with several lawsuits against NBC as well as PJ the whole series has been put on hold.

More and more information has been leaking out about how PJ talks potential "busts" into showing up for meetings at sting houses when they start having second thoughts or outright say they don't want to meet.

PJ Omits the text of their cronies talking these people into going thru with these meetings. Also the cat is out of the bag as far as NBC'S huge payoffs to PJ calling them consulting fee's.

I will absolutely love watching NBC and PJ implode more and more in 2008 and I hope NBC has to file chapter 7 when this is all finished. }

Police Say Ex-Officer Kissed, Fondled 14-Year-Old Girl

Former Northwest Middle School baseball coach and former Greenville police officer has been accused of kissing and fondling a 14-year-old student last week in the school parking lot and outside the girl's home.

Columbus Dean "Ken" Kennett IV, 38, 6 Fiddlers Court in Greenville, was charged with two counts of lewd act upon a minor under age 16, according to warrants, which allege the incidents occurred Feb. 7.Kennett turned himself in to authorities Thursday afternoon and was soon set free on $20,000 bond after an arraignment hearing.

He isn't allowed to be around children who aren't family members, and he can't go to Northwest Middle.Kennett had worked at the school since September 2006 as a boys' baseball coach and an aide checking student tests and other paperwork for a school math program, Greenville County school district spokesman Oby Lyles said.

He resigned from his position Feb. 8, the day after the girl's parents raised concerns, Lyles said.School officials were inquiring about the allegations after the girl's parents complained to the school principal, and Kennett resigned before they had a chance to talk with him, Lyles said.Kennett, a former Greenville police officer from 1993 until 2002, sat in handcuffs and remained mostly silent during his bond hearing as the charges were read against him.

Warrants charge that Kennett kissed and fondled the girl while sitting in his SUV, both in the school's parking lot and in the driveway of the girl's home.An incident report alleges the parents pulled up to their driveway at about 5 p.m. and saw their daughter getting out of a white SUV.The vehicle pulled out driving past them, "leaving the property in a hurry," the report states. The girl's mother asked whom the girl had been riding with, and the girl said it was "Coach Kennett," the report states.

{Here's today's law enforcement officer/teacher story all wrapped into one. There were about three new Policeman that were arrested today for sex charges ranging from soliciting a minor to rape. These stories once shocked me but law enforcement officers seem to be the largest growing segment of the RSO community.

This may actually bode well for the movement as people feel less and less secure when it comes the the nice policeman who is there to protect their families and children. Maybe people might actually start being proactive when it comes to their own security and who knows they might actually start doing their own research.}

Question from Suzanne: I was appalled by your comments on the Lunsford's home life. Old news and after what this family has been through ... to dredge that up again was just sick. Sensationalism ... anything for news. No one comes from a perfect family except for maybe you. That family has suffered enough.

Jami Floyd: First, you have every right to be appalled - that is your First Amendment right. Mine is to say what I said in The Last Word. I don't come from a perfect family, which, if you were listening, you would have heard me say in TLW. I stated very clearly that no family is perfect. Third, the issues I raised have been raised in court on the record (though not before the jury). We tell our viewers all the time about stuff that is not before the jury. Hell, we tell you all the time about stuff that isn't even on the record. This stuff is. So ask yourself: why aren't the other anchors talking about it? Maybe its because of the concerns you express, but there is also a desire in this country to cover stories in a way that makes everything clean and simple - black and white - and that assumes viewers who aren't sophisticated enough to handle the truth, which is always -- in every family -- more complicated. I don't make those assumptions about my viewers. I assume they want to hear the truth. If they are appalled, that is fine, but at least I've done my duty as a journalist and as a citizen who wants to honor a little victim, who had a very hard life -- even before she saw that monster coming from across the street. And, btw, there is a LOT more I could have said but didn't.

Question from sharon: Jami, can you expand on the backstory of Jessica Lunsford's home life?

Jami Floyd: Suffice it to say, that a review online of the coverage, including fine outlets like the St. Petersburg Times, and even coverage Nancy Grace gave to the story back when Jessica was missing, will have further detail for you. My point was only to remind people that things are not always what they seem. People's motives are complicated and viewers should be critical of the way in which we TV-types present the facts.

Question from tara: Jami, welcome. How quickly do you think the sentencing phase will go with Couey, and do you think it will be the DP?

Jami Floyd: Death for sure. No doubt about it. No doubt. Beth has reported the sentencing phase will take ten days to two weeks. I predict a shorter deliberation time than even for the verdict.

Question from Lori: Jami_Floyd, if that's true that Mark Lunsford took his daughter from her mom, then why didn't she legally take action? You know there are always two sides to a story.

Jami Floyd: Yes! There are always two sides to a story! That was my point. Her side is that they had an acrimonious divorce after a seven-year marriage and a stormy relationship that went back ten years all told. She left him a few times, but he always persuaded her to come back. Finally she left the state altogether. He didn't want to break up (again, her side of it), and when Jessica was a year or so old, persuaded Angie to let him take her out for her birthday. Angie says he never brought her back, took her to Florida and named his mother the legal guardian. Now, he may have had good reason. Maybe there was something untoward going on in Angie's home or, maybe, as Angie suggests, it was just sour grapes. I don't know, but these are the questions reporters ask. To answer your second prong: she says she did fight for custody but ran out of money before she could pursue the case to fruition. So that's her side of the story. For his part, Mark won't talk about it, except to say they were estranged.

Question from gandme: Jami, do you know what Couey meant when he stated he wouldn't have done it if his sister had loved him more? I find that disturbing.
Jami Floyd: It is one of the more bizarre and disturbing things about the case. He had had an argument with his sister that day -- the day Jessica went missing, I believe, perhaps the day before. But police think that was some sort of triggering event. Still, that's pretty much all we've heard about the meaning behind the statement. I think we'll hear a whole lot more about it next week.

Question from uma: Was porn found on Mark's computer?

Jami Floyd: There was an argument in court, again out of the presence of the jury, about porn found on the computer. So yes, according to the court record and the police reports, there was porn on the computer in the Lunsford home, BUT there is no way to know who put the porn there. It could have been spammed. It could easily have been downloaded by another member of the family. We don't know the extent of it, in terms of the volume, how MUCH porn, but we do know that the judge considered it, and ruled it inadmissible in the Couey case. I agree, btw. Not at all relevant for a jury to hear that, but it is relevant for those of us who want to understand the entirety of Jessica's life. Mark, btw, is not at all happy that this part of the case is being discussed on Court TV (on Closing Arguments) and apparently on the boards. But, despite Suzanne and others who think it unfair to victims to talk about the totality of the circumstances, I believe our duty is to give you the facts rather than advocate for the victims (or the defendants, for that matter).

Question from nyparrot: Jami: Do you believe we will ever find a cure for a person like Couey...or is life in prison and the DP the only cures for child rape and murder?

Jami Floyd: Oh my goodness. That is the hundred million dollar question. Went out last night with Jamie Wasserman - she's one of the shrinks who is on CTV all the time - and our spouses, one a criminal defense attorney, the other working in a profession having nothing to do with the law. And we spent a good part of the evening debating just that -- well, not debating but wondering that. I'm not dodging, promise. Here's what I think: no, I don't think they can be cured. People like Couey the ten percent of serious sexual predators that Mark Klass talked about on Best Defense yesterday. But I do think two things: first, not all sex offenders are the same. There is a wide range of treatability. A 19-year-old who has sex with a 17-year-old is a sex offender, I think most would agree on the easy side of the scale, and then there's Couey, and everything in between. But we are wasting resources tracking a much larger group than we should be tracking. We need to define the problem more clearly and then give law enforcement the training, tools and money to manage the most serious offenders. And here's the second thing: I think we can't fix the ones who are out there, but we CAN figure out how they got that way and reduce the numbers by getting at the root cause. Okay enough. I could go on and on, but i will say that if we're gonna lock 'em up or execute, let's be honest about that up front. We shouldn't back door our way into changing the Constitution.

Question from Lexi-Atl: If one believes, as I do, that sexual predators are 'grown', not born, what sort of behavioral earmarks should one look for in a younger, developing predator?
Jami Floyd: That's exactly what we were talking about last night. Dr. Wasserman believes it is a combination of nature and nurture, that there is something about the brains of these folks that is different, but that it is only triggered by something in their early childhood environment. She made the analogy to serial killers. As for what to look for: the damage she feels is in the frontal lobe, but you're not gonna see that from the outside! So you look for boys who have been sexually and/or physically abused as children and the earlier the abuse, she believes, the worse the damage. And you look for grooming behaviors, like we all talked about in Michael Jackson. It's a very dangerous business because we don't want to incarcerate or even get to a place where we suspect every man who is kind to children (teachers, doctors, coaches, ministers), but that's what we're coming to in this country, I fear.

Question from Renee: I am confused ... how did this man manage to dig a four-foot hole without detection while a child is missing from a home so close?

Question from DevilsAdvocate: Why didn't the scent dogs pick up her scent 150 feet or yds from her house?

Jami Floyd: Those are both excellent questions that haven't been answered and may not be. Here's another bit of behind-the-scenes: the Lunsfords apparently were considering a lawsuit against the police for failure to find Jessica while Couey says she was still alive. Now, with the prosecution going forward and with what the police say they found on Mark's computer, there is a quid pro quo of sorts: no prosecution/no lawsuit. I think the Lunsfords have a pretty good case for SOMEthing. He's digging a hole. She's in a closet in a small trailer where other adults live. Then there's the fresh earth itself. How do they not SEE that? But at the same time, Mark and his family may want to be done with the whole thing and to sue would mean dredging up the initial days during which Mark and his father were the main suspects (reminding us all why it's important to presume someone innocent until proven guilty. Can you imagine that?!).

Question from gizzmoe: Jami, do you think that Couey's family knew Jessica was there in the house? And maybe the sister had been abused along with Couey and the sister and or people that lived in the house just didn't care what was going on.

Question from tara: Why did they cut deals with the others in that trailer? The state had enough to sink Couey, I feel the others should have been charged.

Jami Floyd: I truly don't know the answer to that. I wasn't there, and I'm not going to speculate. But something very wrong was going on in that trailer beyond just what happened to poor little Jessica. Either these people are so zonked out of it that they truly didn't know or they were complicit in what went down. And if that is the case, it is curious why no prosecutions of others. Yet another area ripe for reporting...
Question from lea: Does the jury consider the retardation issue when they decide the penalty phase?

Jami Floyd: Oh, yeah. That's what the whole thing will be about.

Question from lynn: On a show a few days ago, you called the notion of good and evil "old fashioned." Do you think that this comment may have offended some viewers who believe in good and evil and if it did offend anyone, what are your comments on offending viewers with different belief systems than yourself?

Jami Floyd: I LOVE this question. Okay first, I did not say that notions of good and evil are old fashioned. I said that some people believe in good and evil and an eye for an eye approach to justice. I then went on to say that I don't agree with those folks, but I respect their point of view, especially for its honesty, about the way they would administer justice. As for whether anyone was offended, I did get a good bit of email about it, many from folks who DO believe in pure good and evil, but none of whom were offended -- they simply wanted to continue the dialogue. Now for your last point about how I feel about offending folks: that's not a simple answer. I care very much for other peoples' feelings, more than I should, but The Best Defense is a show with a mission. Nancy has a mission, and I have a mission. I try to be up front with my viewers about that mission so that they won't be too surprised by the things that come out of my mouth. I have many viewers who agree with me, and that's nice, and those who are terribly offended have every right to turn the channel, and I support their freedom to do so. But my favorite viewers are the ones who disagree, but watch anyway, because that is what democracy is all about -- thoughtful discussion of stuff that matters NOT with people who think just like you but instead with people who will challenge your ideas. That's why I love working with the other anchors here. we often disagree and that forces me to rethink my positions and either refine them or change them. So I hope that answers your question.

Sheriff's Deputy Indicted On Sodomy Charges

PINEVILLE, Mo. -- A southwest Missouri sheriff's deputy who helped find the body of a missing child last fall is accused of abusing a 14-year-old girl.
A McDonald County grand jury indicted Jacob Boles on two counts of second-degree statutory sodomy.

The 27-year-old deputy is free on bond after being arrested last week.
Boles could not be reached for comment Tuesday. Court records that might name his attorney were not posted online and the court clerk's office was closed.

Prosecutors said the indictments allege that Boles had deviate sexual intercourse with a 14-year-old girl.

Boles found the body of missing Rowan Ford in a cave in November. Rowan's stepfather and another man are charged with raping and killing the 9-year-old girl.

The Missouri State Highway Patrol investigated the allegations against Boles at the request of the Children's Division of the Missouri Department of Social Services. But Sgt. Kent Casey of the patrol's Carthage office referred all questions concerning the investigation to the McDonald County prosecutor's office.

Prosecutor Janice Durbin declined to explain how the allegations came to light.
Both Durbin and the state patrol confirmed that Boles is a McDonald County deputy.
Boles helped locate Rowan's body on Nov. 9, one week after she disappeared from her home in Stella. Boles and another deputy found her body at the bottom of a locally known cave near Powell.

They were following up on a tip from Rowan's stepfather, David Spears, 24. Spears became a suspect early in the investigation of her disappearance and reportedly mentioned several times to Newton County Coroner Greg Bridges that the cave might be used to hide a body.

Spears and a friend, Chris Collings, 32, of Wheaton, were arrested after the girl's body was recovered. They are charged with sexually assaulting and killing her. A judge entered not guilty pleas for the two.

These people seem to think they are above the law and will not be caught. These are the same people that look upon us in the RSO community with contempt and a judgemental attitude.

Former Iowa trooper arrested for allegedly possessing child porn

A former Iowa State Patrol trooper was arrested after authorities said they found child pornography on his computer during a routine probation check.

Karl Kluender, of Ames, was sentenced to two years probation in 2006 after pleading guilty to indecent contact with a child. He was originally charged with second-degree sexual abuse for molesting the 7-year-old girl in the early 1990s.

During a probation check in June, the child pornography was found on the computers, according to the Iowa Department of Public Safety.U.S. Marshals and agents with the Iowa Division of Criminal Investigation arrested Kluender, 40, this morning on charges of receiving and possession of child pornography.

He was expected to appear before a federal judge this afternoon.

Childers sentencing expected Tuesday

LANDIS, N.C. -- The former police chief in the Rowan County town of Landis is expected to be sentenced Tuesday at the federal courthouse in Greensboro.

Charles Childers, 51, pleaded guilty to federal child pornography charges last year.

Officers arrested Childers after undercover agents said they found him trying to solicit sex from 13- and 14-year-old girls through the Internet.

Court documents showed he sent pornographic pictures, including video of himself, over the Internet, and sometimes used the police station's computer.

He faces up to 45 years in prison.

{The first thing I noticed about this story is how short it is.

Next I could not help but notice it was not on any of the national Media amongst the Natalie Halloway fluff of the day.

Why do stories like this continue to escape the attention of the mainstream media?

I think the answer lies in the fact that you can’t save your face and your ass at the same time.Police Chief's are not supposed to commit sex offences.

Sorry to use the tactic's of the drive by Media in the headline but shocking headlines are the only thing that seems to work and I wanted your attention.

I recently discovered this site thru an RSO hater group and decided to check it out. Apparently this site is Russian but flows thru Canada somehow.

We will call this site "girl talk" and it is a place for "active" pedophiles to meet and gather information on how to meet girls, How to groom girls, How to avoid being caught and all things that interest active Pedo's.

I checked this site out and it appears to be the "anti Christ" of what the rest of us in the RSO community are trying to accomplish.

I would advise ANYONE that is having serious thoughts about committing real sex crimes against children or anyone else to spend a few hundred dollars getting therapy instead of 15 to life in prison.

I'm personally appalled and disgusted that Canada or any other country would allow a site like this to remain active.

I am all for free speech but as you cannot yell fire in a crowded theatre you cannot or should not be allowed to have a web site that encourages and trains people about how to break the law especially when it involves committing sex crimes against children.

ANYTIME ANYONE commits another sex crime against any child in the United States or anywhere else they just add more fuel to the fire and more golden nuggets for the vote seeking politicians.

As the statistics have clearly shown 95% of all new sex crimes committed in the United States will be committed by family members and people with no prior criminal history. NB mayor proposes "safety zones" to keep sex offenders away from kids in public places

NEW BEDFORD — Mayor Scott W. Lang has submitted an ordinance to the City Council that would establish child safety zones around public places where children gather.

The proposed ordinance was drafted at the mayor’s request in the wake of a Jan. 30 sexual assault by a Level 3 sex offender against a 6-year-old boy in the New Bedford Free Public Library.

The ordinance would create specific public areas in the city where child sex offenders are prohibited., including:-- parks-- playgrounds-- recreation centers-- libraries-- schools-- day care centers-- private youth centers-- video arcades-- bathing beaches-- swimming and wading pools-- gymnasiums-- sports fields and facilities-- school and camp bus stops
Parking areas and the land surrounding the facilities also would be part of the child safety zones.

“I do not have any qualms about protecting the kids in our city; they are my number one concern,” Mayor Lang said in a prepared statement.

“I want to send a clear message to all Level 2 and Level 3 child sex offenders that New Bedford is going to do everything it can to protect the children in our community from the individuals who prey on them,” the statement said.

The mayor also has provided the Library Board of Trustees with a list of six recommendations to tighten up security at the library, including installing a system that would require all people entering the facility to show photo identification and produce a library card.

{I have this vision in my mind of people being herded into lines before they can dive in at the beach with police checking ID'S against sex offender registries across the country.

Maybe that’s a good idea, it seems that only when people are greatly inconvenienced that they decide to check out what’s going on and educate themselves rather than taking the word of whatever talking head is in the 6 o clock news. I have a few questions.

If sex offender registries are making children safer HOW DID THIS HAPPEN?

If this guy was that dangerous WHY WAS HE OUT OF PRISON OR TREATMENT??

If laws and regulations are the answer why not make drugs illegal? Why not make robbery and murder illegal? How about domestic violence?

Hey, we could even have "mandatory minimum" sentences that will stop it right?

Shit? We are doing that already aren't we? I think we all know how well that’s going and all the regulations in the world will not completely stop the sexual abuse of children.

This guy was one of the minority 5% of ex offenders that had re offended but you see how the story is sensationalized?95% of all new sex crimes will be committed by people NOT ON ANY REGISTRTY!!

Yet we focus all of our resources and finances on the 5% and ignore the 100% of the population that will commit almost all new sex crimes.

Daniel Snay, 56, of Uxbridge, had been living and working in Massachusetts since 2004. In January, he paid $20 for a "Billion Dollar Blockbuster" scratch ticket at a Hopedale convenience store and hit the jackpot.

When a publicity photograph of Snay picking up his first of 20 annual checks for $500,000 Jan. 30 was posted on the Lottery's Web site, residents called the Massachusetts Lottery Commission about his background.

Lottery officials say he gambled legally, but Snay's story caught the attention of police in neighboring Connecticut, where Snay had lived for several years and allegedly had not alerted authorities that he was moving out of state, as required by law.

Connecticut Trooper William Tate said Snay could face up to five years in prison if convicted of failing to notify authorities of his change of address, a felony in that state. Snay hasn't confirmed his address for the Connecticut registry since May 2004, even though that state requires address verification every 90 days, Tate said.

"We're trying to determine when he moved, why he didn't register with us and whether any charges are warranted," Tate said.

Snay first registered on the Connecticut sex offender list on Feb. 28, 2002. The last address he gave was a multifamily home in the Moosup section of Plainfield.

Snay's lawyer, Joseph Fabbricotti, said when Snay moved from Connecticut, he believed he had to register only in the state he was moving to, Massachusetts.

"If that is incorrect, we'll have to fix it," Fabbricotti said. "He wasn't running. He's been living here (in Massachusetts) for four years."

Snay, a divorced father of five, was convicted several times of indecent assault and battery from 1974 to 1987. Two of the assaults were on a child under the age of 14. He is classified in Massachusetts as a Level 3 offender, those deemed most dangerous or most likely to re-offend.
Uxbridge Police Chief Scott Freitas said Snay's lottery winnings have caused some "conversations" in town, but not an uproar.

"In this particular case, he isn't forbidden from gambling," Freitas said. "He played the ticket and he won."

Snay works as a truck driver for Certified Sales Inc., a boat dealership in Mendon. A message left for him there wasn't immediately returned Monday.

Brian Bethel, one of the company's owners, said Snay has been dedicated and hardworking since being employed there on and off for 40 years. Bethel said he thinks it's unfair that some people are questioning Snay's right to the lottery money.

"This is a ticket that is sold to the public, and as a working citizen in the Commonwealth of Massachusetts, he can purchase the ticket," Bethel said.
"He has paid the piper for what he has done. He's gone over 20 years now (without a conviction)," he said.

Bethel said Snay plans to use the money to pay for his children's education.
"He could have taken the money and left, but he's still working," Bethel said. "He hasn't changed his habits. He works every day."

Officials at the Massachusetts Lottery Commission did not know Snay's background until they were contacted by Uxbridge residents.

"The vast majority of our players are regular, law abiding, hardworking individuals," spokesman Dan Rosenfeld said. "We regret any difficulty this may have caused."

This is the second time in recent months that a convicted felon has won the lottery in Massachusetts. Last month, a Barnstable Superior Court judge approved an agreement to allow convicted bank robber Timothy Elliott to keep a $1 million lottery prize even though he was prohibited from gambling under the terms of his probation. ___

Those sexual predator laws do more harm than good

EVERYONE wants children protected against sexual predators. Few crimes are more heinous than rape or murder of a child. Even lesser molestation can spell years of depression, anxiety and nightmares for victims. Some even suffer self-mutilation and suicidal tendencies.
But the national surge of states adopting Megan's Law and Jessica's Law — online registries of convicted sex offenders and stiff restrictions on where they can live — is going way overboard and causing more harm than good.

The statutes are named after young girls who were abducted, raped and murdered by convicted child molesters. Now there's federal law virtually forcing states to set up publicly accessible Internet registries showing sex offenders' residential addresses.

But the laws are turning out to be crude instruments with disturbing impacts.
First, they don't differentiate between truly serious sex offenders and others convicted of lesser charges such as urinating in public, or teenagers having consensual sex, or kids who expose themselves as a prank.

For one and all, there's a "scarlet letter," notes Human Rights Watch, a nonprofit monitoring group. The Internet registry sites can be accessed by anyone and use often-misleading criminal justice language — for example, "indecent liberties with a child" — to depict simple teenage sex.

Former offenders have a tougher time getting a job or adjusting to normal life. Vigilante violence has led to instances of stabbings, houses burned, even targeted killings by strangers who found names and addresses through online registries. Other registrants have been driven to suicide.

Now things are turning even worse with a spate of laws restricting where former sex offenders can live. Twenty-two states, plus hundreds of municipalities, are setting minimum distances — from 500 feet up to 2,500 feet — that a former offender's residence must be from such places as schools, day care centers, parks, movie theaters, stores, swimming pools, even public transit.

The result, all too often, is to make most — or in some cases virtually all — of a community off-bounds for a former offender to live. An expose last spring by reporter Isaiah Thompson of the Miami New Times revealed a whole colony of former offenders camping out under the noisy Julia Tuttle Causeway because a stiff Miami-Dade County residency requirement left them practically no other place to live.

The offenders are still there, cooking with small portable stoves, using battery-powered televisions and radios, stowing their belongings in plastic bags — and living in fear of vigilante attacks.

One resident was "Big Man" — a 6-foot, 250-pounder forced to leave his home because 23 years ago, when he was 19, he was charged with sexual assault on a minor. Big Man's wife regularly showed up with food and supplies, telling Thompson: "Look at this place! There's no running water to take a shower; there's no toilets. My husband can't work now; nobody's going to hire him."

Big Man departed before Christmas, his case resolved by his parole officers. But with newcomers, the under-the-bridge census is still more than 30. Dade County officials continue to profess no concern.

Which in fact is not unusual. Pressing a residency requirement in Georgia, state House Majority Leader Jerry Keen said: "My intent personally is to make it so onerous on those that are convicted of these offenses that they will want to move to another state."
Mayors and county officials who press harsh residency restrictions are doing the same — effectively banishing individuals who've already been punished by the law. Talk about violating constitutional rights.

Reports from Iowa, which enacted stiff residency restrictions for sex offenders in 2000, show the statute may be promoting conditions that easily lead to crime. Ex-offenders are listing their residence at such spots as "the Raccoon River" or "behind the Target on Euclid." Close to half have simply disappeared, so police no longer know where they are.

Human Rights Watch doesn't underestimate the horror of many sex crimes, or the need for close controls on dangerous offenders. But neither states nor localities, it argues, should pass blanket restrictions on all released individuals. Instead, as a model Minnesota law mandates, restrictions should be based on a careful evaluation of the offender's personal and family situation by a panel of law enforcement, victim advocacy and specialized treatment providers.

The Megan and Jessica cases are deeply tragic, but they miss a glaring fact: that over 90 percent of sex crimes against children aren't committed by outsiders at all, but rather by family members or family acquaintances. If there's prevention work to be done, that's where it should be focused. Not by Internet scarlet letters, and certainly not by residency laws that hound ex-offenders out of their communities, separate them from their families, and quite possibly drive them into isolation and new criminal behavior.

Teacher, Officer Accused Of Sex Crimes With Girl
Fri., Feb. 8, 2008

TURLOCK, Calif. - A police officer and a teacher are both accused of having inappropriate sexual contact with a 17-year-old girl, Turlock police said. Carl Kubicek, a math teacher and football coach at Pitman High School, and Officer Jorge Cruz were arrested, Turlock Police Chief Gary Hampton said.

Kubicek and Cruz didn't know each other, police said.
"It's some of the most egregious conduct that one can consider -- an officer and a teacher to violate the trust that any community member puts in them is not only illegal, but it really strikes of immorality," Hampton said. "Words can't express how sorry I am as the police chief that this has happened in our community.

It is a scar that the police department will now live with."

Kubicek, 35, faces multiple counts of unlawful sexual intercourse with a juvenile and multiple counts of oral copulation, according to the chief.

Kubicek confessed to contact with the girl, which occurred over several months, Hampton said.
The same victim allegedly was assaulted by Cruz, who apparently used coercion and fear intimidation through his position, the chief said.

The girl was allegedly raped by Cruz and became involved with Kubicek a few months later, police said.

The officer was charged with rape, sodomy and kidnapping while under the color of authority, Hampton said, and he has been placed on leave.

Both Cruz and Kubicek are being held at the Stanislaus County Jail.
Cruz is being held on $50,000 bail, Royjindar Singh from the Stanislaus County Sheriff's Department said.

Kubicek has been placed on administrative leave, the district said.
Hampton said police were contacted by the girl's mother, who said she noticed a change of behavior at home.

The victim is scared and upset but in good condition, Hampton said.
The girl trained in the Turlock Police Department's Explorer program, authorities said.

Psychologists and counselors will be at Pitman High School on Monday to help students and faculty, the district said.
Superintendent William H. Gibson said he thinks the case against Kubicheck is a unique, isolated case.

Cruz was arrested by the Stanislaus County district attorney, and the teacher was arrested by the Turlock Police Department, Hampton said.

Every single day in this country another story like this comes out. A teacher and a policeman both useing the same teenaged girl to commit sex offences for months before being caught.

How many stories like this do I need to post before people will realize that someone convicted of a so called sex offence is not some trench coat wearing low life and can be ANYONE.

Two charged with sexual assault of baby

New Britain (WTNH) _ Two New Britain men face multiple counts of sexual assault after police say they sexually assaulted a 3-month old baby girl.

These are truly disturbing charges. A baby discovered in an apartment in New Britain with two men. Police say they were engaged in sex acts with children and computer porn. What's even more gut-wrenching, is this may be the tip of the iceberg.

The door is open at 237 Washington Street, but there is something wrong -- garbage up and down the stairwell -- and nobody home. This is the home of 39-year-old Harold Spurling and 29-year-old Jeffrey Brisson -- both arrested Wednesday by New Britain police and charged with, among other things, sexual assault and risk of injury to a child by sexual contact.

Neighbor Juan Jimenez often saw Brisson with children. "Actually it's kind of shocking to find that out about him," Jimenez said. "Seemed like a pretty cool guy playing out here with some kids not to long ago." An anonymous tip led police to this apartment. Spurling and Brisson wouldn't open the door, so police forced their way inside.

Once there, they discovered a 3-month-old baby girl in a car seat, and a computer filled with child pornography. Then, another horrifying discovery.

"Upon further investigation, they determined Mr. Brisson had a video clip of him molesting the 3-month-old female that was on scene," Sgt. Darren Pearson of the New Britain Police Department said.

"He was always with an infant," Jimenez said. "He had his friends working on his car, he'd be with infant, outside, holding the baby and stuff, I thought that was his daughter."
Police say the baby was being cared for by Spurling and Brisson. Both men remain in custody. Now, both police and neighbors are worried there might be more victims.

Well here is a rare example of a story that needed no sensational spin added however I am going to offer readers the story behind the story.

The statistics are in and the fact remains that almost 95% of all new "sex crimes" committed against Children will be by someone either the child or the childs family knows.

This case is just another example of that because the mother of the child dropped her daughter off into this man's supposed care. Her reasons for doing this are unclear but lets assume that he was someone who she thought she knew and trusted.

Has it ever occurred to any of you on the "OFFENDER HATER" websites that maybe this baby and alot of other children could be saved every year if we stopped wasting all of our time money and police efforts keeping tabs on the 5% of the population that may commit another offence and maybe putting some financial resources and education toward the 100% of the population that will.

For example Harold Spurling and Jeffery Brisson who had NO SUBSTANTIAL CRIMINAL record and absolutely no record for ANY "SEX CRIME" may have been discovered earlier if the ever thinning police staffs and budgets were not all aimed at a population of people with a 5-10 percent risk of committing a "sex offence".

Could our tax monies be better spent on legislation that is fact and stat based instead of fear and shame based??

If we had any kind of sane legislation on the books or actual prevention strategies would this 3 month old baby have not been better served?

Could a few more policeman putting their ears to the local pavement instead of dealing with RSO paperwork have saved this girl?

If the police were not buried under a mountain of useless paperwork behind the current RSO laws would they not have stood a better chance of being able to police the web or make confidential contacts within their particular community?

CAN ANYONE SHOW ME EVEN ONE EXAMPLE OF THE RSO LIST'S SAVING EVEN ONE CHILD??????

07/16/2007Mark Lunsford’s son will spend the next 10 days in jail, but will not be registered as a sex offender after being sentenced Monday for having unlawful sexual contact with a 14-year-old girl.

Clark County (Ohio) Municipal Court Judge Thomas Trempe sentenced Joshua Lunsford, 18, of Mechanicsburg, Ohio, on a Level 1 misdemeanor charge of sexual conduct with a minor.

The charge carries a maximum 180 days in jail and $1,000 fine.A 170-day jail term was suspended as long as the teen successfully completes the year of probation that was also ordered.

Because of the misdemeanor charge, he will not have to register with the state’s sex offender registry.

Joshua Lunsford had been facing a Level 4 felony, which carries a potential 6- to 18-month prison sentence and $5,000 fine on a charge of unlawful sexual conduct.

However, he changed his not guilty plea to guilty after a plea agreement was reached, and a pre-sentence investigation was ordered.That report is similar to ones prepared in Florida where a person’s background and criminal history are considered before a judge decides an appropriate sentence.

According to a police report, the 14-year-old girl’s mother accused Joshua Lunsford of fondling her daughter outside a skating rink and outside a shopping mall March 30 and March 31 while the two were kissing.

Though the girl was considered a willing participant, law prohibits such relationships; because he was four years older than the girl, Joshua Lunsford was initially charged with the felony after his March 31 arrest.

Joshua Lunsford is the brother of Jessica Marie Lunsford, the 9-year-old Homosassa girl raped and killed by a convicted sex offender in February 2005.

John Couey, 48, will appear today before Circuit Judge Ric Howard at the Citrus County Courthouse for a series of hearings to determine if a Miami jury’s recommendation that he be executed for the crime is appropriate.

Joshua Lunsford has lived with Mark Lunsford’s first wife since the two divorced.Mark Lunsford has traveled across the country since his daughter’s death to urge the passage of tougher laws dealing with sex offenders and predators.

Dozens of states, including Ohio and Florida, have signed laws handing down tougher sentences and putting in place more monitoring for such individuals.

A spokesman for the Jessica Marie Lunsford Foundation said Mark Lunsford was out of town Monday. He could not be reached, and a call to his assistant was not returned.

If your new to the growing ex offender sites you have probably just learned about Jessica Junsford's brother being charged with a "SEX CRIME".

As far as I am concerned we as Former Offenders need to use this story as a clarion call for the drive by Media's everytime they spread disinformation about ex offenders or these increasingly ignoramic laws.

Would love to debate someone on this story especially "John Walsh" but he would never agree because that type of TRUE story would not bode well with the cottage industry he has built around the death of his son Adam.

Whats true for my son or your son is of course not true for Mark Lunsfords son.

This information seems to be vanishing from the internet where it was pretty hard to find before but I guess a story like this does not help the Lunsford cause and I am positive thats why he got off so easily on the charge.

If that were my son he would be in prison and would have to register for 25 years according to the new Ohio AWA law and a slam dunk case like this where the mother of the child involved actually saw the crime occur would be an easy feather in the cap for any local prosecutor.

Well Looks like there's Jessica's law for most of us but Josh's Law for others.

Jamie Lynn Spears "16" recently made headlines when she admitted she was pregnant with a "19" year old mans child.

Now I dont know the birthdates of the two involved or how far along the "child" is with her pregnancy but I doubt anyone will try to do the math because this is just another case of " Josh's" Law.

What applies to you me and/or the average teenager does not apply to Josh Lunsford or Jamie Spears 19 year old stud.

The Illinois State Fire Marshall is investigating what caused a former police officer's home to go up in flames.

Multimedia Crews in Beardstown responded to the 1200 block of Wall Street around 12:30 yesterday morning.
Stephanie Wright has more on the story.

Former Beardstown officer Shane Lisenbee is accused of having sex with a girl and committing a sexual act with a boy. Both were under the age of thirteen

His wife Stephanie is accused of having sex with a boy.

Early Wednesday morning, their home went up in flames.

Fire Chief Bobby Joe Brown said, "When we arrived, the porch at the front of the structure was fully involved and the window at the front here and also at the north side of the structure. So much flames were coming out."

Investigators are talking with neighbors and witnesses who may have seen or smelled something. And with the owners still in jail, they say there are no early indications of what caused the fire.

"Does that factor into your investigation at all... The possibility of arson?? It definitely gives us something to look at."
The state's fire marshall is assisting Beardstown with the investigation. Crews say you really can't put a time line on how long that will take. It could take a couple days, or a couple of months.
The state fire marshall's office says investigators still have a lot more work to do. No word yet on a damage estimate.

WOW!! This story has everything. It not only suggest that the people employed to enforce the draconion sex offender laws seem to feel that they themselves are above it but it also shows the Ugly flipside of having these registries in the first place.

This man and his wife did not even get a chance to be listed before the Torch and Pitchfork weilding villiagers burned his home to the ground.

Gotta love the "sheeples" MOB MENTALITY fueled by a media that mostly reports complete lies about RSO Issues and facts.

ST. JOSEPH, Minn. -- My son Jacob was kidnapped on Oct. 22, 1989. Neither his brother nor his friend saw the man's face. He was masked, he had a gun and he ordered them to run to the woods. By the time they looked back, Jacob was gone and so was the man. Since that day, I have been on a journey to find him and to stop this from ever happening to another child, another family.

But I'm worried that we're focusing so much energy on naming and shaming convicted sex offenders that we're not doing as much as we should to protect our children from other real threats.
Many states make former offenders register for life, restrict where they can live, and make their details known to the public. And yet the evidence suggests these laws may do more harm than good.

Jacob's Law was the first federal attempt to prevent convicted sex offenders from repeating their crimes after release. It was the outcome of my unwanted education in sexual violence against children.

Soon after Jacob was taken, I learned that sexual motives are usually behind child kidnapping. That was a thought totally out of my realm of consciousness. Who would do that? Who would sexually harm a child? As the search for Jacob went on, I asked law enforcement, what do you need? An investigator told me: A ready list of potential suspects, a central database of offenders convicted of sexual violence against children.

The Jacob Wetterling Crimes Against Children Sex Offender Registration Act was part of the 1994 Crime Bill signed by President Bill Clinton. Our goal was to give law enforcement a tool to help build safer communities. Back in 1990, when we first recommended registering convicted sex offenders, we were met with resistance: "You can't do that. These people have rights!" How times have changed. Few people today are concerned about the rights of sex offenders. Most now complain our laws are not tough enough.

But they might be missing some basic facts. First, in most states "sex offender" covers anyone, including juveniles, convicted of any sexual offense, including consensual teenage sex, public urination and other non-violent crimes. Second, Jacob was the exception, not the rule: more than 90 percent of sexual violence is committed by someone the child knows. And third, most shocking to me, sex offenders are less likely to re-offend than commonly thought. A Department of Justice study suggested ex-offenders have a recidivism rate of 3 percent to 5 percent within the first three years after release.

Another study found that, after 15 years, three out of four do not re-offend.
Shortly before Jacob's Law was passed, Megan Kanka was kidnapped, raped and murdered. Her parents felt it wasn't enough for law enforcement to know where sex offenders were: they thought we should all know. Maybe, if they'd known that there was a convicted sex offender living next door, their child would be alive today.

Megan's Law was created to let people know when a violent offender was released into their community, so they could talk to their children and perhaps save another child from sexual violence. But the law has been expanded so that now anyone with an Internet connection can download details about almost any offender, whether or not they pose a risk, and whether or not they live nearby.

Are these policies working? Are our "get tough on sex offenders" laws having the desired effect? Human Rights Watch has taken on the challenge of looking at sex offender policy to see what parts are working and what aren't.

This week it published a 143-page report, "No Easy Answers: Sex Offender Laws in the United States." The researchers examined whether we are building safer communities with these laws, and what issues policy-makers should consider.

HRW found that many laws may not prevent sexual attacks on children, but do lead to harassment, ostracism and even violence against former offenders. That makes it nearly impossible to rehabilitate those people and reintegrate them safely into their communities -- and that may actually increase the risk that they'll repeat their crime.

We need to keep sight of the goal: no more victims. We need to be realistic. Not all sex offenders are the same. Not all sex offenses are the same. We need to ask tougher questions: What can we do to help those who have offended so that they will not do it again? What are the social factors contributing to sexual violence and how can we turn things around?

None of us want our loved ones to be victims of sexual violence. None of us want to be the parent or sibling or child of a sex offender. But since the vast majority of sexual assaults are committed by someone known to the family, sexual violence becomes personal very quickly. It affects all of us.

We need better answers. We need to fund prevention programs that stop sexual violence before it happens. We need to look at what can help those released from prison to succeed so that they don't victimize again -- and that probably means housing and jobs and treatment and community support. Given that current laws are extremely popular, taking truly effective measures may exact a high political price. But that's surely not too much to pay to prevent the kidnap, rape or murder of another child.

Offenders need not be damned

Few crimes create more fear among community members than sexual offenses.
Not surprisingly, this fear and the ability of politicians to take advantage of it has resulted in inconsistent and incomprehensible policies toward sex offenders. Such policies often not only decrease the ability of offenders to reintegrate into society but also call into question some of the basic principles on which our judicial system is based.

Earlier this week, an Associated Press story detailed the situation of a group of sex offenders living under a bridge in Miami. The offenders said that the passing of local laws about where offenders could live — akin to other cities’ bans on living within 1,000 or more feet of a church, school or other community area — prevented them from getting housing elsewhere. Thus, 19 of the offenders created a communal living space under the bridge and registered the location with their probation officers as their place of residence.

Before being told last week to move out, the men had lived under the bridge for an entire year.
Last March, spurred by Green Bay’s march toward implementing strict restrictions on where sex offenders could live, I wrote an opinion column decrying this practice of legislating segregation. Later, in September, fellow columnist Bassey Etim wrote an excellent column on the continuing spread of these restrictions throughout the nation. The situation in Florida is the exact kind of outcome that Mr. Etim and I warned about: Despite serving their sentences, these released offenders have little hope for reintegration into society after they are released.

Unfortunately, the restrictions on where sex offenders can live are not the only aspect unique to their situation. Even when a particular town or city allows an offender to settle down, he or she is often the subject of a neighborhood meeting that notifies everyone of the potential danger they may present.

In Wisconsin, the addresses of all the state’s sex offenders are readily available via a purpose-built website. One Wisconsin legislator even suggested making sex offenders put specially colored license plates on their cars.

If they aren’t becoming less dangerous in prison, then the ongoing efforts to isolate them from society once they are released certainly aren’t helping them further adjust to a different style of life outside of prison.

Honestly, I find these practices baffling. What is the point of releasing an offender if he or she won’t get a chance to normally reenter society? Won’t the isolation and contempt of their neighbors only increase the likelihood of re-offending?

Taken together, the laws that single out sex offenders have the effect of being another dividing line in our society. This type of law seeks to specifically discriminate against a defined group after they have already served what should be a substantial punishment. This type of law seems particularly foolish considering the fact that sex offenders are among the least likely of felons to ever commit another crime.

Reports from Washington and Tennessee correctional systems hold up this fact, as well as a massive 1994 study by the United States Department of Justice.
In the future, absent a court decision striking down residency restrictions or a change in the trend toward enacting them, there doesn’t seem to be anything to stop communities from enacting restrictions on any felon. After all, they are far more likely to re-offend than a sex offender.

Unfortunately, the effect of this would be to create a batch of second-class citizens. Of course, in many states felons aren’t really even citizens because they are no longer allowed to vote. But that’s a topic for another day.

Now, I am open to compromise on this issue. Perhaps more freedom after a release for the first sex offense should be compromised with lifelong punishments for second-time offenders. This way, their fates are in their own hands. An offender can choose the path of reintegration after his or her first crime or face a life sentence, hard labor or a firing squad, for all I care.

I decided to shed light on this issue once again because I think the situation that occurred in Florida is deplorable and should be avoided at all costs. The criminal justice system has enough problems with it already. In the future, it should not be used to hound and segregate offenders for their entire lives after they have paid an appropriate punishment for their actions.

Citizens United To Remedy Sex Offender Registries

Citizens United to Reevaluate Sex Offender Registries (CURSOR) is an organization that seeks to educate and inform New Hampshire citizens about our state’s sex-offender registry laws, how they both overreach and fall short of their goals, and what we can do about it.

We recognize that not everyone registered as a sex offender is an actual ongoing public safety threat, and instead of perpetuating “feel-good” solutions that simply don't work, we seek to bring real, evidence-based solutions to the table in order to deal with sex-offender management issues.

Our focus is the ineffective restrictions and regulations that waste taxpayer dollars and actually serve to undermine communities’ abilities to protect themselves effectively. This is not to say that we are completely against sex-offender registries as a whole, but what we are against is the broad brush approach that sweeps all offenders into the same basket.

We do not sympathize with violent child molesters or predatory rapists. But we do understand that not every registered sex offender is indeed a violent molester or rapist, and we hope to educate and inform other New Hampshire residents as to this important fact about sex offenders and sex-offender registries.

Hmmmmm It seems that new sites are popping up left and right that are all trying to get the truth across to the general population.

Unity will be the key in this battle and we as former offenders can no longer afford to remain silent as the vote seeking politicians try to rapidly erode whatever rights we have left.

Get organized and get active if we do not stand up for ourselves who exactly will?

An Encrypted Laptop Poses A Constitutional Dilemma In Vermont Child-Pornography Case

BURLINGTON, Vermont, Feb. 7, 2008

(AP) When Sebastien Boucher stopped at the U.S.-Canadian border, agents who inspected his laptop said they found files containing child pornography.

But when they tried to examine the images after his arrest, authorities were stymied by a password-protected encryption program. Now Boucher is caught in a cyber-age quandary: The government wants him to give up the password, but doing so could violate his constitutional right against self-incrimination by revealing the contents of the files.

Experts say the case could have broad computer privacy implications for people who cross borders with computers, PDAs and other devices that are subject to inspection. "It's a very, very interesting and novel question, and the courts have never really dealt with it," said Lee Tien, an attorney with the Electronic Frontier Foundation, a San Francisco-based group focused on civil liberties in the digital world. For now, the law's on Boucher's side: A federal magistrate here has ruled that forcing Boucher to surrender the password would be unconstitutional.

The case began Dec. 17, 2006, when Boucher and his father were stopped at a Derby Line, Vermont, checkpoint as they entered the United States. Boucher, a 30-year-old Canadian citizen who lives in Derry, New Hampshire, cooperated with agents, telling them he downloads pornography from news groups and sometimes unknowingly acquires images that contain child pornography. Boucher said he deletes those images when he realizes it, according to an affidavit filed by Immigration and Customs Enforcement.

At the border, he helped an agent access the computer for an initial inspection, which revealed files with names such as "Two year old being raped during diaper change" and "pre teen bondage," according to the affidavit. Boucher, was accused of transporting child pornography in interstate or foreign commerce, which carries up to 20 years in prison. He is free on his own recognizance. The laptop was seized, but when an investigator later tried to access a particular drive, he was thwarted by encryption software from a company called Pretty Good Privacy, or PGP.

A grand jury subpoena to force Boucher to reveal the password was quashed by federal Magistrate Jerome Niedermeier on Nov. 29. "Producing the password, as if it were a key to a locked container, forces Boucher to produce the contents of his laptop," Niedermeier wrote. "The password is not a physical thing. If Boucher knows the password, it only exists in his mind."

Niedermeier said a Secret Service computer expert testified that the only way to access Boucher's computer without knowing the password would be to use an automated system that guesses passwords, but that process could take years. The government has appealed the ruling. Neither defense attorney James Budreau nor Vermont U.S. Attorney Thomas Anderson would discuss the charge. "This has been the case we've all been expecting," said Michael Froomkin, a professor at the University of Miami School of Law. "

As encryption grows, it was inevitable there'd be a case where the government wants someone's keys." Authorities have encountered such dilemmas before, but have used other methods to learn passwords, including installing surveillance devices that capture keyboard commands. Sometimes investigators have given up before a case reached the courts. In a 2002 case, the FBI used a keyboard program to obtain gambling records from the computer of Nicodemo Scarfo, Jr., the son of a jailed New Jersey mob boss.

In another case, an officer found child pornography on the laptop of a man who flew into Los Angeles International Airport from the Philippines. But a federal judge later suppressed the evidence, ruling that electronic storage devices are extensions of the human memory and should not be opened to inspection without cause. That case did not hinge on a password, though. Orin Kerr, a law professor and computer crime expert at George Washington University, said the distinction that favors the government in Boucher's case is that he initially cooperated and let the agent look at some of the laptop's contents.

"The government can't make you give up your encryption password in most cases. But if you tell them you have a password and that it unlocks that computer, then at that point you no longer have the privilege," he said. Tien, the attorney with the Electronic Frontier Foundation, said a person's right to keep a password secret is a linchpin of the digital age. Encryption is "really the only way you can secure information against prying eyes," he said. "If it's too easy to compel people to produce their crypto keys, it's not much of a protection."

Well the right to not incriminate oneself apparently only applies in certain cases. We as RSO'S or anyone that looks like us are considered sub humans civil rights do not apply.

This is a very interesting case it highlights how easy it is for people to try to strip the rights of others away because of their own personal agenda's or dislikes. I mean the bill of rights applies to all American citizens except for those that disgust us or those that we fear.

Did Jamie Lynn's Boyfriend Break the Law?

LOS ANGELES — Jamie Lynn Spears may not be the only one who is expecting. Casey Aldridge, the boyfriend Jamie Lynn says got her pregnant, could also be "expecting" — a visit from people wearing badges.

The Internet is abuzz with the question: Since Jamie Lynn is 16 years old, does that make her a victim of statutory rape?

If Casey is indeed the dad-to-be, and the blessed event took place in Jamie Lynn's home state of Louisiana, then the act could be classified as a "Felony carnal knowledge of a juvenile," defined as "sexual intercourse with consent between someone age 19 or older and someone between age 12 and 17."

However, some reports say Casey is 19, some reports say he is 18.
If Casey were tried and found guilty, he could face a maximum possible term of 10 years imprisonment, possibly with hard labor.

According to Louisiana Revised Statutes 14-80 and 14-42, an individual can legally consent to sexual intercourse when he/she is 17 years of age. And in cases (such as Spears') where the victim is 15 or 16, the defendant (Aldridge) must be no more than two years older for the sexual intercourse to be legal.

The law, like everything else, is different in California. But Casey could still be in trouble if the couple did the deed in the Golden State, where Spears resides while filming her Nickelodeon show "Zoey 101."

"It states clearly in the Californian Penal Code that any person who engages in an act of unlawful sexual intercourse with a minor (under 18) who is not more than three years older or three years younger than the perpetrator, is guilty of a misdemeanor and faces up to one year in a county jail," said criminal defense attorney Jim Hammer.

“But if Aldridge is actually more than three years older, he could be up for a felony, which carries a maximum three years in prison.”
According to the code, "unlawful sexual intercourse" is an act of sexual intercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor.
“Police can openly investigate the case, but the biggest challenge would be to determine [in] what state the act actually took place,” Hammer said.

However, criminal defense lawyer Christopher Darden says charges are unlikely.
“The father of the child may have committed a criminal offense or misdemeanor by having unlawful sex with a minor,” said Darden. “But unless the complaint is filed from the minor’s parent, it is unlikely that this will be taken further.”

The New York Post cited Aldridge's age as 18, and Deputy Sheriff Jimmy Travis of Tangipahoa Parish, La., where the Spears family lives, told the paper that Jamie Lynn and her boyfriend didn't break any state laws if they conceived in Louisiana.

"From my preliminary investigation, she is 16 and he is 18," he said. "If, in fact, it happened in the state of Louisiana, that does not violate any criminal statutes."
He said the age of consent is 17, but that officials don't prosecute if the two are no more than 24 months apart in age.
"Sixteen and 18 is OK, 15 and 19 is not," he said.

A rep for Jamie Lynn declined to comment on the pregnancy reports, which appeared in OK! Magazine on Wednesday.
"What is in OK! is their story," said the spokeswoman. "We cannot comment on its accuracy."

Judge stays portion of new sex offender notification law

CLEVELAND — A federal judge has extended the deadline for sex offenders to challenge their reclassification under a law that took effect this year.

U.S. District Judge Patricia Gaughan also stayed the law’s community notification provision for those who weren’t subject to it under the old law.

Under the Adam Walsh Act, offenders are automatically classified in one of three tiers by their crime without considering the likelihood of re-offending.Gaughan made the rulings in a class action lawsuit filed by sex offenders who say the law denies them their constitutional right because their classification can be changed without a hearing.

This is truly wonderful to watch. This court from this part of the state says one thing and another court 2 counties over says somthing else.

Judges from other districts are clueless and sitting on their hats completely clueless and in the meantime criminal cases continue to backlog while the sherriff's try to dig out from underneath a mountain of useless paperwork.

MANSFIELD — Up to 100 sex offenders living in Richland County have appealed new state classifications setting stricter requirements for residence reporting.Richland County Common Pleas Clerk of Courts Lin Frary said the Ohio Attorney General’s office reclassified convicted sex offenders between July 1 and Dec. 1.

Registered letters notified them they were placed in one of three new tiers.Convicted offenders had 60 days to contest their new classification. Some offenders may also file motions relieving them of community reporting requirements, if that wasn’t required in their case before, Frary said.

The clerk of courts believes the onslaught of appeals is likely to end this week.Changes in sex offender classifications are a result of Ohio Senate Bill 10, which imposed more stringent reporting.“Ohio is now supposed to be in step with the federal Adam Walsh Act,” Frary said.Senate Bill 10 organized sex offender classifications into three tiers. Each tier has registration requirements ranging from 15 years to lifetime. In-person verification at the county sheriff’s office also varies by tier, from annual to every 90 days.

Reclassification caused a major spike in the common pleas court caseload at the beginning of the year, Frary said.The clerk’s office processed 21 administrative appeals of government agency decisions in 2007. This year there have already been 83, most filed by those appealing the new sex offender classifications, Frary said.According to Frary, many convicted sex offenders filed appeals without a lawyer.“We had people coming in saying ‘Do you have petitions (to contest this)?”The final total may be reduced somewhat, as cases are merged where both the sex offender and their attorney filed with the court, she said.Ben Kitzler is among area attorneys representing clients appealing reclassification.

He will contest the constitutionality of reclassifying large groups of people based on an edict from state legislators.“They have taken a system that used to classify people into different categories, based on a judge’s consideration of the case after hearing evidence and weighing facts about the offender and about the offense,” Kitzler said.Judges decided whether that individual was a predator who might harm the community by reoffending, or a person who made a bad mistake, he said.Under SB 10, the sole consideration for classification is the specific number of the offense the person was convicted for under the Ohio Revised Code.“We have taken the discretion from the hands of judges and simply enabled a lot of politicians to decide,” Kitzler said. “The law says at the end of your case, you should know what your punishment is.”The attorney said he’ll be interested to see how local judges respond to the appeals

You know I must admit I am getting a thrill watching my state meltdown with all of these petitions, Lawsuits, class action suits and the like. Suicide Solution?

Published January 27, 2008. MONROE — A Loganville man who was being investigated for allegations of child molestation was found dead in a parking lot Wednesday night. Walton County Sheriff’s Office investigators were called to the house of a 16-year-old juvenile who alleged Frederick Mitchell IV, 46, of Loganville, molested her.

During the course of the investigation, detectives received a call from Mitchell. According to reports, Mitchell told detectives he needed to see them immediately.

The detectives, who were still conducting their investigation with the juvenile, tried to delay the meeting until Thursday morning. Arrangements were eventually made for him to come by the sheriff’s office. “The detectives came back to the office and Mitchell never showed up,” WCSO Capt. Chris Cannon said, adding they waited for some time before opting to go and look for him. In their search, a detective located Mitchell’s vehicle in a parking lot.

“When they approached the vehicle, they found Mr. Mitchell dead from an apparent self-inflicted gunshot wound,” Cannon said.A gun was found in the vehicle still in Mitchell’s hand, according to officials.The investigation into the death was initially turned over to the Monroe Police Department, as the body was found in the Southern Pipe Company parking lot on South Broad Street.

MPD Chief Keith Glass called in the Georgia Bureau of Investigations to assist in the processing of the scene.

It bleeds it leads? Especially if you can add the words "child molester" to the story. Now I dont know the particular circumstances of the story but I do know that we now live in a society where the mear "allegation" of a sex crime is enough to drive someone to suicide.

Child Molester? Now that is a term we as RSO'S have had to listen to from the hoople headed misunformed public for years. No wonder we are all clumped on the same list.

An 18 year old man who has consensual sex with his 15 year old girlfriend right beside the 70 year old grandfather who rapes his 4 year old grandaughter? We are a nation both obsessed and terrified of our sexuality.

I don't know what exactly Mr Mitchell did or did not do but it is chilling to think that we now live in a society where suicide is preferable to even the accusation of a so called "sex crime".

Four Year old "sex offenders" ??

In 1994 a Child Protective Services official instructed his employees to dig up child sex abuse cases to justify the agency's budget. Before long 43 parents and Sunday school teachers in Wenatchee, Wash. had been arrested and charged with nearly 30,000 cases of sex abuse involving 60 children. It wasn't until four years and many ruined lives later that the Wenatchee witch hunt was exposed as a fraud.

A decade later, we seem to be on the verge of another moral panic involving sex abuse, but this time with a new wrinkle: its perpetrators are as young as four years old. Last year a pre-schooler in Waco, Tex. hugged a female aide as he boarded the school bus. The four-year-old’s embrace lingered a bit long, and soon the boy was required to defend himself from a charge of sexual harassment.

The scarlet letter of “inappropriate physical contact” is now stamped on the child’s school records.In December a kindergartener in Hagerstown, Maryland pinched a classmate’s bottom. For that he, too, was branded a sexual harasser. To those who asked how a little boy could understand, much less commit such an action, spokeswoman Carol Mowen came up with this loopy explanation: “It’s important to understand a child may not realize that what he or she is doing may be considered sexual harassment, but if it fits under the definition, then it is, under the state’s guidelines.”Middle school students in McMinnville, Ore. designated Fridays as Slap Butt Day.

Those days “pretty much we would just go around slapping people’s butts,” recounted Megan Looney. But one day the local police got wind of the racy activities. They came in and arrested 12-year-old Ryan Cornelison and 13-year-old Cory Mashburn, charging each with five counts of felony sex abuse.Six times the teenage boys were subjected to a strip search. Six days later they were released from jail. So cause for concern, yes -- a plague, definitely not.Lest you accuse me of going wobbly on the horrific crime of child sex abuse, I will remind you that when the Congress held hearings on the problem in the early 1970s, similar white-hot rhetoric was bandied about in a calculated effort to convince the federal government to invest millions to halt the abuse “epidemic.

”The bigger problem with the AP study is that was run by journalists, not trained researchers. And on Friday, Kay Sorg, a science teacher at Albany Middle School, Calif. appeared in court following an accusation of having sex with a high school girl.According to a 2004 Department of Education report, “Educator Sexual Misconduct: A Synthesis of the Literature,” student surveys reveal that only 57% of sex offenders are male. That’s a far cry from the nine-in-10 statistic reported by the AP. So how do we explain the discrepancy?A few years ago Tina Smith wrote a book on Perspectives on Female Sex Offending: A Culture of Denial. Smith reveals that when it comes to female-perpetrated sex abuse, we live in a state of selective amnesia.

Thanks to chivalrous school administrators, female abusers are often given a second chance and their record stays clean.So before we stick men with the sex offender moniker and ban them from the schools, let’s be sure to look at both sides of the sex abuse equation.

I believe news like this only further proves the point that these laws are about politics and money. This manufactured "epidemic" of sex offences/offenders can be traced back for years. Sex sells? You bet it does but not only that, sex "FUNDS" too.

As an RSO I can personally attest to the obsession childrens services agencies locally and across our nation seem to have about sexual abuse cases.

If they can make a sex abuse case then they can have soundbites and statistics when it comes time to assign funding to the agency.

If they can make a case that a 4 year old boy hugs a teacher to long then this completely "articicial epidemic" gains one more statistic nevermind how many lives are destroyed forever because of it.

NEW YORK (AP) — A police detective and a woman forced a 13-year-old runaway to work as a prostitute at parties around the city, telling her that if she tried to escape the officer would make her sell herself on the streets, prosecutors said Wednesday.
Wayne Taylor, 35, and Zelika Brown, 29, were arrested on charges of kidnapping, promoting prostitution, assault and endangering the welfare of a child, the Queens district attorney's office said.

Taylor, a 14-year New York Police Department member assigned to the housing bureau, was suspended without pay, the department said. Both he and Brown pleaded not guilty Wednesday.
Taylor's attorney, Peter Brill, told reporters his client "has the right to have the case proven against him beyond a reasonable doubt." Randall Unger, an attorney for Brown, did not immediately respond to an after-hours phone message seeking comment.

Taylor and Brown each face up to 25 years in prison if convicted. They were each being held on $250,000 bail, prosecutors said.

According to prosecutors, the teenage girl ran away from her Brooklyn home on Jan. 10 and met someone who offered to get her a job dancing for money at parties. That person then introduced her to Brown, who told the girl that she had bought her for $500 and that she had to work off the debt, prosecutors said.

Taylor instructed the girl to tell people that she was 19 years old and that she charged $40 to $80 for sexual acts, prosecutors said.

Taylor and Brown took the girl to parties throughout the city where she was told to have sex with about 20 men in exchange for money given to the pair, prosecutors said.
While holding the girl against her will, Brown chided her for not earning enough money and slammed her head into the floor, prosecutors said.

Taylor told the victim that if she failed to earn more money or tried to leave, he would force her to work as a prostitute on the streets, prosecutors said. He told the girl an alarm on the house would alert him if she tried to leave, they said.

A 17-year-old girl was also being held on charges of promoting prostitution, assault and endangering the welfare of a child, prosecutors said. Her arraignment was scheduled for Wednesday night. She will be charged as an adult.

The 17-year-old was told to oversee the 13-year-old at parties, prosecutors said. She is accused of slapping the 13-year-old at Brown's behest for being too talkative with customers and punching the girl, giving her a black eye, prosecutors said.

The 13-year-old escaped to her family, who took her to a police precinct, police said.
"This case is every parent and every child's worst nightmare, made even more frightening by the fact that one of the defendants is a police officer who swore to uphold the law and the community he serves," District Attorney Richard A. Brown said in a statement.

High Cost Of New Sex Offender Law

It's a new law which is supposed to keep you protected and, especially, protect your children from sexual predators. Ohio Senate Bill 10 just took effect last month. But critics say the law will not only cost taxpayers millions of dollars, but will actually make things more dangerous.

Local 12 Reporter Jeff Hirsh reports on how a well-intentioned plan may end up backfiring. It means more paperwork, more computer work. "It's tripled. The workload for us has tripled." And because of all that... Deputy Adam Breeze, Hamilton County Sheriff's Office: "No free time to do anything else.

If we need to look at some files, or write a warrant, or investigate some offenders, it really cracks down on our time, in that aspect, with the tripling of our registration with offenders." Ohio has had a sex offender registration law for a decade, making names and addresses public. But Senate Bill 10 pushes thousands of the lowest level offenders statewide into the highest level ... and adds years of reporting requirements. For example, under the old law, bottom tier offenders registered their addresses with the sheriff once a year for ten years. It went on a website, but neighbors were not notified by postcard.

Under Senate Bill 10, most of those offenders now have to register every 90 days for life, with postcard notification of neighbors every time they move. In Hamilton County alone, 600 low level offenders are now high level offenders... same people, no new crime, just a new label."The sheriff's office is not taking a position pro or con on the law. They have to enforce it. They're simply pointing out some of the unexpected implications. But there's another organization which definitely has a point of view." "It's political pandering." The Ohio Justice and Policy Center is suing to get Senate Bill 10 thrown out.

The suit challenges retroactively changing someone's offender status But the group also says upgrading low level offenders adds fear, without adding safety. Margie Slagle, Ohio Justice & Policy Center: "What the politicians don't tell folks is that most of the people on this list are not child molesters.""Now they're being told that they're the worst of the worst, and threats to children, and that's ludicrous." Until the lawsuits are resolved, Hamilton County is not sending out postcard notifications for low level offenders who've been upgraded.

But if the law stays the same, postage costs will more than triple to half a million dollars yearly, because hundreds of notification cards are sent out per offender. Jeff Hirsh, Local 12. Ohio Attorney General Marc Dann and the sponsor of Senate Bill 10, Senator Steve Austria of suburban Dayton, have both said the measure is constitutional and will be effective in protecting children.

Well here we go with another feel good do nothing one size fits all law. Can you believe this Legislation was by co sponsored by "Mark Foley" of Florida?

Last time I checked he was not on the list.

This is a law that nobody in the state wanted to implement with the exception of our new Attorney General the former Ambulance chaser "Marc Dann" from Youngstown. You see its a win win situation for the politicians.

No matter if it destroys the lives of thousands of former offenders and their families who were upgraded from the lowest level, having to report only once a year to the new Tier 3 Predator status. Having to report every 90 days for life.

What did that sheriff say? Same person? No new crime? Just new Label!!!

I have been on the registry for 8 years and saw this writing on the wall years ago but this law is "SO FLAWED" that I believe it will be the one that finally gets struck Down by the US Supreme court.

The vote seeking politicians could care less they will have their soundbite come election time and they can always blame the court later.

In the meantime the Ohio courts are in meltdown mode clogged up with thousands of petitions contesting their re-classifications not to mention at least one class action suit that involves all 88 counties in the state.

When will someone finally look at the research and statistics that are NOW AVAILABLE that clearly show that Former RSO'S are the LEAST LIKELY group to commit ANY NEW CRIME??

This issue will effect ALL FIFTY STATES later this year as they have been threatened by the federal government with losing 10% of one federal grant allocated to law enforcement. Many states are already balking at the high cost of implementation.

This law is just another unfunded mandate that will most likely die or be radically changed when the thousands of lawsuits that have been filed topple the state budget.

Boundaries left many living under bridges, until nowAbout 50 sex offenders statewide who call bridges, parks or other public spaces home have been told they must find a new place to live, and it better have walls.Caught off guard last month when the Department of Transportation evicted as many as nine sex offenders living under the Oakland Park Boulevard bridge, the state is cracking down on those who haven't been able — or haven't wanted — to find permanent housing.

Last Tuesday, probation officers arrived at the state's most infamous home for sex offenders, a bridge under the Julia Tuttle Causeway in Miami, and told 19 people they must relocate. Officials are giving offenders similar ultimatums across Florida, although no one will be arrested immediately because "being homeless isn't a crime," corrections department spokeswoman Gretl Plessinger said.State law requires all people on probation to have permanent addresses so officers can pop in for surprise visits or make sure they aren't violating curfew.

But after the 2005 rape and murder of a 9-year-old Central Florida girl at the hands of a convicted sex offender, many cities restricted sex offenders from living near places where children gather.That sharply cut their housing options and many wound up registering a bridge as their residence."We're urging them to find housing, and jobs for those who are out of work, and we're helping them with that," said Plessinger. "To manage these offenders, we must know where they are. And Fort Lauderdale made it clear that we didn't want to be in that situation."Last month Fort Lauderdale police, acting on a Department of Transportation trespassing notice, evicted offenders living under the Oakland Park Boulevard bridge. Because offenders can't relocate without permission, several of them made frantic calls to corrections officials, Plessinger said.

The state decided to put more pressure on offenders to find a real home and many have already been placed with friends and relatives who live outside restricted boundaries. Others have been more reluctant or unable to find affordable homes in approved areas, causing corrections officials to escalate their push."I want to make it clear that we have not imposed a deadline, but we want these offenders to re-enter society," Plessinger said. "Many of them have had ample opportunity and, frankly, have stopped trying. That's not an option; they have to find homes."Lee Chang, 25, thought he would live in his mother's home in Miramar after being released in September for lewd and lascivious battery on a minor.

But they learned soon after she rented it that the house is in a restricted area.Now he's at a halfway house after spending four months sleeping in a car parked under the Oakland Park Boulevard bridge.He shared the mosquito-infested space with four other sex offenders. The state Department of Corrections allowed them to stay there if they could not find anywhere else to live that did not violate city laws."I don't think anyone would want to be in this situation," Chang said one night while sitting on the car hood.

Last month, even the bridge went off limits.Some of Chang's bridgemates were moved to a campsite in the Everglades, said Joellyn Rackleff, spokeswoman for the corrections agency."It's a temporary stopgap until they find something," said Rackleff.The lack of housing poses "a serious problem," said state Rep. Jack Seiler, D-Wilton Manors, chairman of the Broward County Legislative Delegation. "What you don't want to have happen is to have them just drop off the map."Lobbyist Ron Book, who pushed for stronger laws, was unsympathetic. "When an individual gets convicted for sexually deviant behavior, at the end of the day nobody wants them living in their apartments," he said.Critics say the laws create a false sense of security, because most offenders can still be near children during the day.

"It's naive to believe we can solve the problems of sexual abuse by banishing criminals from our communities," said Dr. Jill Levenson, assistant professor at Lynn University in Boca Raton and a sex crimes policy analyst.In addition, Florida law treats "Romeo and Juliet" offenders — typically, a couple in which one sexual partner is underage — the same as predators and pedophiles. Therapists say that when convicted felons cannot secure a place to live, it's more likely they will resume a life of crime.The state did not classify Chang a predator.

In 2005, authorities charged him with lewd and lascivious battery against afamily member. He said he's not sure what happened because he was drinking and smoking and blacked out."I don't own this charge because it's not me," Chang said. "I'm not like those other guys." He served two years and a month and is on probation for 12 years."I knew [finding a home] was going to be hard," said Chang. "But I didn't know they would put me under a bridge."The Department of Corrections told him to be there from 10 p.m. to 6 a.m. daily. At first he was the only one, but within months at least four other men showed up. Some were predators, forced to wear ankle bracelets so they could be monitored.

Every night at about 9:45 p.m., Chang would arrive in his father's red Mercury Tracer with a bottle of water and his cell phone. He said he never felt truly safe, but he learned how to sleep in the car despite discomfort to his 5-foot-11-inch frame. With no bathroom, the mosquito-infested site smelled strongly of urine.He spent his nights playing games on his cell phone, fishing or listening to his car radio. At 6 a.m., he headed for Miramar to return the car.His mother, Mercedes Lopez, said she worried about her son's safety."You have so many crazy people," said Lopez. "You don't know if someone is going to go there with a gun and shoot everybody.

"Miramar city attorney Jamie Cole defends the law, saying not all of the city's housing falls within the ban and "to have sexual offenders living within a short distance of a place where children congregate would be counterproductive."Chang's attorney, Chris Mancini, said such laws are unconstitutional and create a critical mass of homelessness.Considering where some of the offenders ended up, Chang said, the halfway house is not bad."I get to sleep now," he said. "I have a roof over my head."

So Its come to this? The state forces these people to live under a bridge then when they start feeling the national HEAT and bad press they make them move.
